6.2A
Page 1

REPORT

April 26, 2010

SUBJECT
Final Acceptance - Hoover Park Renovation Project

RECOMMENDATION
Accept, by motion, the Hoover Park Renovation Project and authorize the release of
bonds and retention according to city procedures.

BACKGROUND
On December 15, 2008, Council awarded the construction contract for the Hoover Park
Renovation Project to the lowest responsive and responsible bidder, Jos. J. Albanese,
Inc. of San Jose, for their bid of $485,272.00.

This project replaced playground equipment, widened concrete paths for improved
maintenance vehicle access, replaced the outdated hand ball court with a new
basketball court, modified the landscaping, improved the entry ramp leading to the Boys
and Girls Club, and installed new seat wall caps. The work was substantially completed
and the park re-opened for use in July of 2009. Staff delayed seeking Council's formal
acceptance of this project until this time due to a dispute between the general contractor
and their electrical subcontractor. The dispute was resolved in February, 2010.

The Hoover Park Renovation Project has been successfully completed in accordance
with the plans and specifications for a total contract cost of $526,617.31. Two (2)
change orders were issued for the sum total of $41,345.31, which is 8.50/0 more than the
contract amount originally awarded. Change orders included work to completely rebuild
the outdoor court rather than patch the existing court, and additional site preparation
and concrete work in front of the new restroom to comply with accessibility
requirements.

ALTERNATIVES
Council may choose not to accept the project, or authorize the release of bonds and
retention which would be contrary to the terms of the contract and prior Council action.

FISCAL IMPACT
Sufficient funding for the work of this construction contract has been previously
appropriated as appropriated as Capital Projects Fund - Hoover Park Renovation and
Restroom.
