EXHIBIT D-1 <br />FORM OF <br />CONSTRUCTION OF IMPROVEMENTS PERMIT APPLICATION <br />AND PERMIT <br />PERMIT APPLICATION <br />CITY AND COUNTY OF SAN FRANCISCO WSIP PROJECT <br />CONSTRUCTION OF IMPROVEMENTS WITHIN THE CITY OF REDWOOD CITY <br />The CITY AND COUNTY OF SAN FRANCISCO, a municipal corporation acting by and <br />through its Public Utilities Commission ("Applicant"), hereby applies for a permit from the CITY <br />OF REDWOOD CITY ("City") to construct improvements as per attached plan(s) <br />This permit application and the Construction of Improvements Permit ("Permit") to be issued <br />pursuant to this application are made pursuant to and in accordance with the Memorandum of <br />Agreement ("MOA"), dated August , 2009, by and between Applicant and City. The <br />parties' respective insurance and indemnity obligations in connection with the construction work <br />authorized by this Permit shall be as stated in the MOA.. <br />(1) Applicant submits herewith a plan of the proposed construction, and a check for <br />the sum of $ as an initial deposit to cover the checking of plans of the <br />proposed construction. <br />(20 Because Applicant (i) is a municipal corporation and (ii) all construction work <br />authorized by the Permit will be performed pursuant to a contract between Applicant and its <br />contractor that will require such contractor to provide a performance bond in favor of Applicant, <br />no bond in favor of the City will be required from Applicant.
