<br />1'- <br /> <br />o <br /> <br />o <br /> <br />Zoning Administrator <br />City of Redwood City <br />101 7 Middlefield Road <br />Redwood City, CA 94063 <br /> <br />Re: Findings on Appeal of Zoning Administrator's Issuance of <br />Variance Permitting Encroachment of Handicap Ramp Into <br />Required Side Yard, and Permitting Excess Deck Elevation At 815 <br />Canyon Road, Redwood City, California <br /> <br />Hearing having been duly noticed and held by this Council on July <br />11, 1994, on the appeal of Mr. and Mrs. Umberto Bagnarol ("Appellants") of the <br />decision of the Zoning Administrator to approve the application of Ms. Eva <br />Kolesnikow ("Applicant"), for a variance to allow the construction of a deck and <br />handicap ramp within the required side yard setback of property located at 815 <br />Canyon Road, Redwood City, California, (the "Property"), the Appellant, the <br />Applicant, the Zoning Administrator, and all other persons interested in the <br />matter having been heard and having been given the opportunity to be heard, <br />and this Council having fully considered the matter; <br /> <br />NOW, THEREFORE, this Council hereby finds, concludes and <br />orders as follows: <br /> <br />FINDINGS <br /> <br />1. The Property is located in the R-1 (Residential-Single Family) <br />Zoning district (S5.1 et seq., Ordinance No. 1130, as amended, the Zoning <br />Ordinance of the City of Redwood City [all section references herein are to said <br />ordinance unless otherwise indicated]). <br /> <br />2. Applicant applied for variances to the provisions of Section <br />32.3 .a( 4) (Supplemental Side Yard Requirements) to allow the construction of a <br />handicap ramp within the required 6-foot side yard (S5.9a(2)) and to the <br />provisions of Section 32.11 (Construction in Yards) to allow construction of <br />decking within said side yard, the elevation of which exceeds one (1) foot as to <br />a portion thereof. Said application was granted by the Zoning Administrator <br />after hearing thereon on May 25, 1994. <br /> <br />The variance, as granted, permits the construction of a deck <br />exceeding the limitations of Section 32.11 d, to wit: in excess of one foot above <br />finished grade. Said variance was granted upon the apparent finding that the <br />deck constructed at the Property conformed, at least in part, to the requirements <br />of Section 32.11d, but exceeded the one (I)-foot limitation as to portions <br />thereof. <br />
