<br />o <br /> <br />o <br /> <br />Re: Findings, Conclusion and Order on Appeal of Zoning <br />Administrator's Issuance of Use Permit for Drive-Through specialty <br />coffee Business at 528 Woodside Road, Redwood City, California <br /> <br />Hearing having been duly noticed and held by this Council on July 18, 1994, <br />and the matter having been continued to August 1, 1994, on the appeal of <br />Norton Brothers Enterprises, dba Expresso Lane ("Appellant") of the decision <br />of the Zoning Administrator to approve the application ofMr. Jeff Titterington <br />of Expresso Express Company ("Applicant"), for a use permit to replace an <br />existing drive-through structure and associated business with a free-standing <br />structure for use as a drive-through facility offering specialty coffees for sale to <br />the public (the "Project") at 528 Woodside Road, Redwood City, California (the <br />"Property"), the Appellant, the Applicant, the Zoning Administrator, and all <br />other persons interested in the matter having been heard and having been given <br />the opportunity to be heard, and this Council having fully considered the <br />matter; <br /> <br />NOW, THEREFORE, this Council hereby finds, concludes and orders as <br />follows: <br /> <br />FINDINGS <br /> <br />1. The Property is located in the CN (Neighborhood Commercial) zoning <br />district (8 13.1 et seq., Ordinance No. 1130, as amended, the Zoning Ordinance of the <br />City of Redwood City [all section references herein are to said ordinance unless <br />otherwise indicated]). <br /> <br />2. Applicant applied for a use permit pursuant to the provisions of Sections <br />13.4 and 42.2 to permit the operation of the Project from a commercial coach structure <br />to be placed in the parking lot of the neighborhood shopping center located at the <br />Property. The structure would not contain bathroom facilities for use by patrons or <br />employees. Vehicular access to the structure would be provided from existing <br />driveways providing ingress and egress to the shopping center parking lot from and to <br />Woodside Road. <br /> <br />3. The Zoning Administrator issued the use permit on May 26, 1994, after <br />hearing duly noticed and held on May 11, 1994. Appellant filed timely appeal of the <br />issuance of the permit by letter dated May 31, 1994. <br /> <br />Appellant, through its appeal, objects to the issuance of the use permit on the <br />grounds that inadequate or illegal provision has been made for restroom facilities, <br />inadequate provision has been made for vehicular access/egress from the Project such <br />that traffic congestion may occur on Woodside Road, and Applicant may take <br />advantage of an existing roof sign to erect a sign prohibited by the City's sign <br />regulations. <br /> <br />4. The use permit, as issued by the Zoning Administrator, includes the <br />following pertinent conditions: <br />
