6.4A <br />Page 2 <br />G. Base Flood Elevation changes due to physical alterations: <br />1. Within six months of information becoming available or project completion, <br />whichever comes first, the floodplain administrator shall submit or assure that the <br />permit applicant submits technical and/or scientific data to FEMA for a Letter of Map <br />Revision (LOMR}. <br />2. All LOMR's for flood control projects are approved prior to the issuance of building <br />permits. Building Permits must not be issued based on Conditional Letters of Map <br />Revision (CLOMR's). Approved CLOMR's allow construction of the proposed flood <br />control project and land preparation as specified in the "start of construction" <br />definition. <br />Revision of section 41.19. Standards for Subdivisions, paragraph B to read: <br />B. All subdivision plans will provide the elevation of proposed structures} and <br />pad(s). If the site is filled above the base flood elevation, the as-built information <br />for the lowest floor elevation, pad elevation, and the lowest adjacent grade for <br />each structure shall be certified by a registered civil engineer or licensed land <br />surveyor and provided as part of an application for a Letter of Map Revision <br />based on Fill (LOMR-F) to the Floodplain Administrator and FEMA. <br />A LOMR is FEMA's modification to an effective FIRM, or Flood Boundary and Fooodway <br />Map (FBFM), or both. LOMRs are generally based on the implementation of physical <br />measures that affect the hydrologic or hydraulic characteristics of a flooding source and <br />thus result in the modification of the existing regulatory floodway, the effective Base <br />Flood Elevations (BFEs), or the SFHA. <br />A LOMR-F is FEMA's modification of the SFHA shown on the FIRM based on the <br />placement of fill outside the existing regulatory floodway. <br />The Floodplain Administrator is defined in the ordinance as the position established to <br />administer and enforce the Floodplain Management Ordinance, and according to <br />Section 41.14, Designation of the Floodplain Administrator, the City Engineer is <br />appointed to that position. <br />The "start of construction" definition pertaining to land preparation is stated in Section <br />41.6, Definitions, as "land preparation such as clearing, grading and filling, installation of <br />streets and/or walkways, excavation for a basement, footings, piers or foundations or <br />the erection of temporary forms, installation on the property of accessory buildings such <br />as garages or sheds not occupied as dwelling units or not part of the main structure." <br />The lowest floor elevation is defined in Section 41.6, Definitions, as "the lowest floor of <br />the lowest enclosed area, including basement." <br />The pad elevation, for slab-on-grade construction, is the elevation of the foundation pad. <br />ALTERNATIVES <br />Council may choose not to amend the ordinance, which will result in the City being non- <br />compliant with NFIP. <br />
