7.B <br />Page 2 <br />{Customer Work Order Agreement) requires the City to enter into an agreement with A <br />Bright Idea for the total installed project cost of $7fi,360.90. Pursuant to the Customer <br />Work Order Agreement, SNIC Energy Watch will make the rebate payment directly to A <br />Bright Idea. Payment of the rebate will lower the City's actual costs for this project to <br />$60,596.27. The City is expected to fully recover its cost though energy savings within <br />3.2 years. It should also be noted that the unit prices made available to the City through <br />its participation in SIV1C Energy Watch have been markedly discounted. <br />Government Code Sections 4217.11 through 4217.17 provide that notwithstanding any <br />other provisions of law, a public agency may enter into an energy service contract on <br />terms that its governing body determines are in the best interests of the public agency. <br />SMC Energy Watch has already prescreened and selected A Bright Idea as one of its <br />preapproved participating contractors. Furthermore, A Brighf Idea previously and <br />successfully provided similar services to the City through the Association of Bay Area <br />Governments Energy Watch Program. Staff finds that based on A Bright Idea's past <br />performance, that it would be in the best interests of the City of Redwood City to <br />continue to work with this proven contractor. The decision must be made at a regularly <br />scheduled public hearing, public notice of which is given at least two weeks in advance. <br />ALTERNATIVES <br />Council may choose not to approve the agreement and direct staff to modify the work or <br />terms of this project. <br />FISCAL IMPACT <br />The total contract cost for the work is $76,360.90. Of this amount, $60,596.27 is <br />payable by the City. The balance, $15,764.63, is provided by PG&E as a rebate <br />payable directly to the contractor. Funds for this contract have been appropriated in <br />the current budget as Capital Projects Fund -Civic Facilities Relamping Program which <br />has an available balance of $94,225.89 as of March 31, 2010. <br />1' <br />Brian Lee, P.E.
