6.1 D <br />Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />May 24, 2010 <br />SUBJECT <br />Revocable Encroachment Permit to Kaiser Permanente for roadway improvements and <br />underground utilities installation and maintenance ' <br />RECOMMENDATION <br />Approve and authorize, by motion, execution of Grant of Revocable Encroachment <br />Permit to Kaiser Permanente for roadway improvements, underground utilities <br />installation, and on-going maintenance, for a portion of Marshall Court within the public <br />right-of-way. <br />BACKGROUND <br />Kaiser Hospital has several plans currently under review for their new replacement <br />Hospital and associated support structures for their new campus. The project's precise <br />plan was prepared in 2003. In December 2008 the Planning Commission approved <br />Kaisers Phase I plan which included a conceptual plan of the new hospital building <br />envelope, entrances, and access points. <br />Part of the reconfiguration of the entrance to the hospital involves the use of Marshall <br />Court connecting to Kaiser's Campus Drive which can also be accessed from Maple <br />Street. This was a preferred alternative for access rather than direct entry from <br />Veterans Boulevard. The Office of Statewide Health Planning and Development <br />(OSHPD) is the State's permitting authority for the hospital and is currently reviewing <br />the plans. Pending approvals, Kaiser proposes to begin construction by July or August <br />of this year. <br />Building, Infrastructure, and Transportation Department staff has been working with <br />Kaiser on the abandonment of the cul-de-sac portion of Marshall Court. Kaiser is the <br />exclusive benefactor of this portion of the roadway and abandoning will relief the City <br />from maintenance responsibilities. After abandonment, the right-of-way reverts back to <br />the underlying property owners. However, title search yield information that the <br />underlying ownership of this area may not be Kaiser. Granting a revocable <br />encroachment permit allows Kaiser to meet their construction schedule while the title <br />matter is settled. Staff recommends that a Revocable Encroachment permit be issued <br />for a period up to 4 years, which should provide sufficient time for Kaiser's consultants <br />to coordinate a successful abandonment of this area. <br />The Permit will allow Kaiser to install and maintain new improvements such as <br />sidewalks, street trees, roadways, underground oxygen and electrical conduits serving <br />the new Hospital and Central Utility Plant. The City reserves the right to revoke this <br />encroachment permit should a public need arise for the use of Marshall Court. <br />Attached is a map showing the location of the area of the revocable encroachment <br />permit. <br />
