6.2D <br />Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />May 24, 20'10 <br />SUBJECT <br />Final Acceptance of the 2009-2010 Tree Preservation and Sidewalk Replacement <br />Project, SpenCon Construction, lnc. of Danville, CA. <br />RECOMMENDATION <br />Accept by motion the completed improvements constructed during the 2009-2010 Tree <br />Preservation and Sidewalk Repair Project, from SpenCon Construction, Inc., Danville, <br />CA and release the retention in the amount of $75,849 withheld during construction in <br />accordance with City procedure. <br />BACKGROUND <br />On July 9, 2009, the City Council awarded the 2009-2010 Tree Preservation and <br />Sidewalk Repair Program contract to SpenCon Construction Inc. of Danville, CA for <br />their bid of $712,920. Work occurred in front of almost 300 parcels in the area bounded <br />by Carson Street, Foothill Street, McGarvey Avenue and Alameda de las Pulgas. <br />Additional work was performed in front of ten parcels on Maxwell Lane which is located <br />in the area where the next sidewalk replacement project is to work. All of the work <br />required during this contract has been performed to City standards. The work performed <br />exceeded the original contract amount by $45,567 or approximately 6.39%. Of note <br />during this contract period was the continued use of poured-in-place rubber sidewalk, <br />diverting over 2,419 recycled passenger car tires from the landfill. Sections of rubber <br />sidewalk were installed in front of approximately 150 homes, and 56 concrete <br />wheelchair accessible curb ramps were installed. The "Succession Tree Planting" effort <br />resulted in 72 tree removals, and we have installed 86 replacement trees, so far, in <br />cooperation with CityTrees and their planting events throughout the year. Due to the <br />presence of underground water and gas main lines in several areas, some of the newly <br />planted trees were not planted in the exact location where the removed tree was <br />growing. <br />ALTERNATIVES <br />City Council could decide to not accept this project.
