<br />7A <br />Page 1 <br /> <br /> <br />June 7, 2010 <br /> <br />SUBJECT <br />Appeal of an Initial Study/Negative Declaration for a Zoning Text Amendment pertaining <br />to lot size regulations for the Residential Duplex (R-2) Zoning District in Article 6 of the <br />Zoning Ordinance <br /> <br />ReCOMMENDATION <br />1, Deny the appeal by motion, and thereby uphold the adoption by the Planning <br />Commission of the Initial Study/Negative Declaration (IS/ND) regarding the R-2 <br />Zoning Text Amendment, as revised (Attachment 1), with the following finding: <br />On the basis of the entire record before the City Council, including the Initial <br />Study, any comments received, and the testimony and evidence presented at the <br />June 7, 2010 public hearing, that there is no substantial evidence that the project <br />will have a significant effect on the environment, and that the IS/NO reflects the <br />lead agency's independent judgment and analysis. <br />2. Introduce an Ordinance amending Article 6 of the Zoning Ordinance for the R-2 <br />Zoning District (Attachment 2) pursuant to the Planning Commission's, <br />recommendation. <br /> <br />BACKGROUND <br />Currently, the text of Article 6 - Residential Duplex (R-2) District of the Zoning <br />Ordinance specifies the minimum lot sizes for projects of up to three dwelling units: <br />single.family homes (5,000 square feet), duplexes (7,500 square feet) or triplexes <br />(10,000 square feet). However, Article 6 does not specify how to determine the <br />minimum lot area for projects providing more than three dwelling units on properties <br />greater than 10,000 square feet in size. For lots larger than 10,000 square feet the City <br />has been applying lot area standards on an incrementally proportional basis which <br />generally fit between the R-1 and R-3 Zoning Districts and are in conformance with the <br />General Plan densities (Attachment 3). ' <br /> <br />The purpose of the proposed zoning ordinance amendment is to codify lot area <br />standards for multiple-dwelling projects on lots larger than 10,000 square feet. Based <br />on an analysis of past practice, staff developed and analyzed three alternative lot area <br />standards for consideration by the Planning Commission and City Council which could <br />be adopted for lots larger than 10,000 square feet. The three alternative increments <br />are: <br /> <br />1. 2,500 square feet per additional unit beyond 10,000 square feet <br />2. 3,333 square feet per additional unit beyond 10,000 square feet <br />3. 5,000 square feet per additional unit beyond 10,000 square feet <br />
