7A
Page 58

individual privacy, open space, and facilities." [R2: Article 6.1] (followed
by an implied density grid)
. Implied: R2 is not zoned for apartments.
. Yet, City interpretation for R2 density uses a formula designed for apartment
zoned districts.

4) Clarit)' for City Int.erpretation
City Justification for Revision
. "In order to provide clarity on this practice, the City will revise Zoning Ordinance
to codify this interpretation."
. The Zoning Ordinance does not require clarification for an IllEGAL
practice.
. The objective of this revision is to modify the permitted use.
. The objective of this revision is to modify the permitted density.
. The objective of this revision is to double the permitted density of single family
dwellings from 8.7 per acre to 17.4 per acre.
. The objective of this revision is to convert R2 into a new apartment zoned district
(table followed to reflect this).
. The objective of this revision is to convert R2 into a condo zoned district (table
followed to reflect this)
. If the City was truly interested in clarifying, why was the 2004 Housing Element
clarification of R2 density not include in the NEW GENERAL PLAN?

Conclusion
With this Zoning Ordinance revision, the City is attempting to legalize an ILLEGAL
interpretation of R2 density using the past application of the same ILLEGAL
interpretation as the sole justification for the revision.

. Immoral? Unethical? Insulting? You decide.

Recommendation
1. Find that the existing Zoning Ordinance specifies density of lots of all sizes.
2. Find that the Initial Study and associated documents are not acceptable.
3. Do not consider any modification to the Zoning Ordinance related to R2 until after
the Kentfield lawsuit is decided.
4. Please add the 2004 Housing Element R2 density clarification to the New
General Plan.

Challenge

. The City's interpretation of R2 density allows 16 detached single-family
dwelling buildings on one (1) acre.
. BEFORE YOU VOTE: Can you explain to the Public how 16 single-
family dwelling buildings on one (1) acre does not violate one or
more of the following Zoning Ordinances and General Plan
limitations?
. The following structures and uses are permitted in the R2 District:
A. Single-family dwellings;
B. Two (2)-family (duplex) dwellings;
C. Three (3)-family (triplex) dwellings;

Page 7 of 24
