people involved in the process. Proposals were received from William Beeger, Jim <br />Beeger, Steve McLaren and Ben Kopf. In terms of staff analysis of the proposals, <br />the Towne Ford proposal (Ben Kopf s) was responsive in that it discussed the auto <br />uses within the area. The recommendation of November 4 remains unchanged. <br />Public Comment: <br />Jim Beeger stated that his family is asking that the Agency vote against the <br />applicant and giving them exclusive control of their property, potentially, forcing <br />them into an eminent domain situation. He stated that the City has the freedom to <br />select the best party to do business with and his family is asking for the same. <br />Tom Ruby, representing the Beeger family, stated that the interest is in time to <br />allow the two parties to reach an agreement amongst themselves. <br />Ben Kopf stated that he is seeking the opportunity to negotiate an owner <br />participation agreement for Phase I in the South Main Street Redevelopment <br />Area. He stated his disappointment with accusations and personal assaults in <br />letters from Jim Beeger and Bill Beeger. He further stated that the only pertinent <br />issue is that the parties were unable to reach an agreement for the purchase and <br />sale of the Beeger property. He stated that the vote is not about condemnation or <br />eminent domain, not about Phase II planning area. It is Phase I must come first. <br />The vote is whether or not to allow the opportunity to support the continuation and <br />growth of automobile dealerships in the Phase I planning area. Mr. Kopf <br />summarized with respectfully requesting the next 60 -90 days to negotiate an <br />owner participation agreement. <br />Council discussions and clarifying questions ensued. <br />M/S Hartnett/Ruskin to adopt the following recommendation: <br />1. That the Agency Board by motion direct staff to negotiate an Owner <br />Participation Agreement (OPA) with Ben Kopf for Phase I Area of South Main <br />Street Redevelopment Planning Area; with the understanding that all costs <br />associated with this process will be borne by Mr. Kopf; <br />The motion passed by a majority roll call vote, with Council Member Jordan <br />voting no and Council Member Howard absent. <br />M/S Hartnett/Pierce to adopt the following recommendation: <br />2. That the Redevelopment Agency by motion postpones action in Phase II until <br />staff brings a proposal for action in the area. Staff recommends that when the <br />time comes to proceed with planning in Phase ll, participation and discussion <br />will occur with the owners and tenants in the area; <br />The motion passed by a unanimous roll call vote by those present. <br />MINUTE ORDER RD 02 -27 <br />6.
