In terms of staff analysis of the proposals, the Towne Ford proposal (Ben Kopf s) was responsive in that it discussed the auto uses within the area. The recommendation of November 4 remains unchanged. Public Comment: Jim Beeger stated that his family is asking that the Agency vote against the applicant and giving them exclusive control of their property, potentially, forcing them into an eminent domain situation. He stated that the City has the freedom to select the best party to do business with and his family is asking for the same. Tom Ruby, representing the Beeger family, stated that the interest is in time to allow the two parties to reach an agreement amongst themselves. Ben Kopf stated that he is seeking the opportunity to negotiate an owner participation agreement for Phase I in the South Main Street Redevelopment Area. He stated his disappointment with accusations and personal assaults in letters from Jim Beeger and Bill Beeger. He further stated that the only pertinent issue is that the parties were unable to reach an agreement for the purchase and sale of the Beeger property. He stated that the vote is not about condemnation or eminent domain, not about Phase II planning area. It is Phase I must come first. The vote is whether or not to allow the opportunity to support the continuation and growth of automobile dealerships in the Phase I planning area. Mr. Kopf summarized with respectfully requesting the next 60 -90 days to negotiate an owner participation agreement. Council discussions and clarifying questions ensued. M/S Hartnett/Ruskin to adopt the following recommendation: 1. That the Agency Board by motion direct staff to negotiate an Owner Participation Agreement (OPA) with Ben Kopf for Phase I Area of South Main Street Redevelopment Planning Area; with the understanding that all costs associated with this process will be borne by Mr. Kopf; The motion passed by a majority roll call vote, with Council Member Jordan voting no and Council Member Howard absent. M/S Hartnett/Pierce to adopt the following recommendation: 2. That the Redevelopment Agency by motion postpones action in Phase II until staff brings a proposal for action in the area. Staff recommends that when the time comes to proceed with planning in Phase ll, participation and discussion will occur with the owners and tenants in the area; The motion passed by a unanimous roll call vote by those present.
