6.28
Page 1

REPORT

To the Honorable Mayor and City Council
From the Ci Mana er

June 28, 2010

SUBJECT
Final Acceptance - 2008-2009 Slurry Seal Project

RECOMMENDATION
Accept, by motion, the 2008-2009 Slurry Seal Project, and authorize the release of
bonds and the retention according to city procedures.

BACKGROUND
On July 27, 2009, Council awarded the construction contract for the 2008-2009 Slurry
Seal Project to Graham Contractors, Inc. of San Jose. The project was awarded for a
base bid of $276,685.69. Construction began in September, 2009, and concluded in
June, 2010. The project is successfully completed in accordance with the plans and
specifications. One (1) change order for a credit of $42,539.62 was issued. The final
contract amount is $234,146.07, and 15.4%) less than the contract amount initially
awarded. The final cost of a slurry seal project is adjusted based on the, actual
quantities of materials used. Less sand and oil were used on this project than originally
estimated which reduced the final cost of the project.

This project resurfaced roadway segments in an area approximately bordered by Fifth
Avenue to the north. Rolison Road to the east, Marsh Road to the south, and Bay Road
to the west. Portions of Vera Avenue and the roadway segments between Veterans
Boulevard and U.S. 101 were also resurfaced.

ALTERNATIVES
Council may choose not to accept the project or authorize the release of bonds and
retention which would be contrary to the terms of the contract, prior Council action, and
public contracting code.

FISCAL IMPACT
Sufficient funding for the work of this project was previously approved and appropriated
as Transportation Fund (Measure UA") - Street Pavement Management Program.

~d~~~v~ ~~

M.
