<br />7.A & 7.B <br />Page 1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />July 12, 2010 <br /> <br />SUBJECT <br />Levy of Benefit Assessments for Fiscal Year 2010/2011 for the Seaport Centre <br />Maintenance District, and the Seaport Boulevard Landscape Maintenance District <br /> <br />RECOMMENDATION <br />Adopt two (2) separate resolutions for the Seaport Centre Maintenance District and the <br />Seaport Boulevard Landscape Maintenance District, contingent to the result of the <br />Districts' property owners' election, to: <br /> <br />1. Approve the assessments for Fiscal Years 2010-2011 through 2014-2015, and <br /> <br />2. Request that the County Controller levy assessments for Fiscal Year 2010/2011 for <br />the Seaport Centre Maintenance District in the amount of $187,000.00, and for the <br />Seaport Boulevard Landscape Maintenance District in the amount of $212,500.00. <br /> <br />BACKGROUND <br />These two small districts were formed to pay for the maintenance of facilities that were <br />determined to require a level of service greater than regularly required. The Seaport <br />Centre Maintenance District was established in 1987 to pay for the maintenance of <br />stormwater pump stations, levee systems, and utilities in easement. The Seaport <br />Boulevard Landscape Maintenance District was established in 1987 to pay for the <br />maintenance of additional landscaping and stormwater facility along Seaport Boulevard. <br /> <br />The districts are annually and individually assessed to allow assessments to be levied <br />and collected by the San Mateo County Tax Controller and Collector's Office. Both the <br />Seaport Centre Maintenance and the Seaport Boulevard Landscape Maintenance <br />Districts are in the final year of their approved five-year budgets. A public hearing and a <br />property owners' election to approve a five-year budget for FY 2010-11 through FY <br />2014-15 is set for July 12,2010. -Notices and ballots were mailed to property owners on <br />May 25, 2010, per the procedures required by Proposition 218. Contingent to the <br />outcome of the property owners' election, Council mayor may not order the levy of <br />assessments. Related budgets, assessments, and City Manager's Report are available <br />for review in the City Clerk's Office. <br /> <br />ALTERNATIVES <br />Contingent to the outcome of the property owners' election, Council may choose not to <br />authorize one or both of the tax levies, and consequently, not provide additional <br />services to area property owners. Reduced maintenance levels of some systems such <br />as the storm pump stations, and levees may compromise public health and safety. <br /> <br />FISCAL IMPACT <br />The districts' finances are separate from the City's General Funds; therefore, this action <br />has no fiscal impact to the City, unless Council decides to use General Funds to <br />subsidize the districts' operations. <br />
