must be maintained, and ingress and egress from properties adjoining the Public <br />Rights-of-Way must be protected; <br /> <br /> c. the placement and maintenance of Newsracks on or within Public <br /> <br />Rights-of-Way are historically associated with the sale and distribution of newspapers, <br />periodicals, and other publications and that such use shall not be denied; <br /> <br /> d. the provisions of this Chapter should be consistent with the <br /> <br />requirements of the Americans with Disabilities Act ("ADA"; 11 USC 12101, et seq.) for <br />the benefit of the public; <br /> <br /> e. due to the unique nature of the Downtown Area, additional criteria shall <br /> <br />be applied to the Downtown Area to preserve and enhance both the appearance and <br />function of Broadway and other public improvements in the Downtown Area, as well as <br />to ensure the ability of businesses to operate without unreasonable interference from <br />Newsracks; <br /> <br /> f. there is a compelling interest in protecting the physical and <br /> <br />psychological well being of minors; this interest extends to shielding minors from the <br />influence of literature that is not obscene by adult standards but which is harmful to <br />minors; <br /> <br /> g. the purpose of this Chapter is to encourage the installation of <br />Newsracks and to balance the foregoing interests through the regulation of the time, <br />place, and manner in connection with the placement, installation and maintenance of <br />Newsracks. <br />43.2 <br /> <br /> For the purposes of this Chapter, the following words and phrases shall have <br /> the meanings respectively ascribed thereto: <br /> <br /> 7/2/97 2 <br /> 7/9197R <br /> 7/16/97R <br /> <br /> <br />
