T2 A -30 <br />the employee is approved to use family /medical leave to take care of that <br />family member. <br />Failure to comply with the above requirements may lead to denial of leave. <br />9.9.3 The employee may elect, or the City may require the employee, to substitute <br />accrued vacation leave or other accrued time off during family /medical leave. <br />Sick leave may be used during the period of family /medical leave in <br />accordance with the provisions of this MOU. <br />9.9.4. The City will maintain contributions for the employee's health benefits under <br />group health plans at the same level as prior to the leave, in accordance with <br />the Family & Medical Leave Act. The worker may return to the same position, <br />or another position with equivalent benefits, pay and other terms and <br />conditions of employment upon completion of the leave. <br />9.10 Absence Notification <br />Failure on the part of an employee to report for duty or notify the designated <br />management official one -half (1/2) hour prior to the employee's scheduled starting time <br />as to a reason why the employee cannot report may subject the employee to disciplinary <br />action. <br />SECTION 10. HEALTH PLANS <br />10.1 Health and Cafeteria Plans <br />10.1.1 The City agrees to contract with the California Public Employee's Retirement <br />System (PERS) for participation under the Public Employees Medical and <br />Hospital Care Act (Government Code Section 22751, et, seq.), pursuant <br />specifically to Government Code Section 22825 and 22850. <br />10.1.2 For the period September 1, 2002 through August 31, 2005, the City's <br />maximum contribution for each active employee for a Health Benefit Plan (as <br />referenced in Government Code 22825) shall not exceed sixteen dollars <br />($16.00) per month. <br />10.1.3 The health plans offered shall be those of the California Public Employee's <br />Retirement System (PERS). <br />10.1.4 For PSA members employed by the City, who have ten (10) years of service <br />and retire under the City's retirement, the maximum City contribution toward <br />health plan coverage shall be equal to the percent of premium paid for an <br />active employee, for the same plan, for the period September 1, 2002 through <br />August 31, 2006. <br />10.1.5 In the event there are any costs not charged to the City due to delays by PERS <br />and/or other administrative agencies in calculating or reporting these costs, <br />W <br />
