The imposition of the Impact Fee on new uses within a certain portion of the <br />Downtown (the "Exempt Downtown Area ") could be a substantial barrier to new <br />development. <br />C. The exemption from the payment of Impact Fee for new uses except <br />professional, medical, business and administrative office uses within the Exempt <br />Downtown Area will create an incentive for the development of housing and will <br />enhance the retail environment. <br />D. There will be no significant loss of revenue and any potential loss will be offset by <br />Redevelopment Agency funds to be spent on pedestrian, transit, and traffic <br />improvements in the Downtown area. <br />SECTION 2 . Chapter 18, Article XV, Section 18.253, is hereby amended to read as <br />follows: <br />"Section 18.253 - Exemptions and Credits: <br />A. Any claim of exemption from the Impact Fee shall be made no later than the time <br />of application for a building permit or other entitlement for a Development. Any <br />claim not so made shall be deemed waived. The following shall be exempted <br />from payment of the Impact Fee: <br />1. Alterations or expansion of an existing building where no additional Dwelling <br />Units are created, where the use is not changed, and where no additional <br />vehicular trips will be generated over and above those generated by the <br />existing use, as determined in accordance with the criteria specified in <br />Section 18.249; <br />2.
