08/09/2010 <br />ATTACHMENT 2 <br />EXHIBIT C <br />individual lots for which building permits may be issued without further subdivision. The <br />term "Final Subdivision" shall not include any Assessor's Parcel Map or subdivision map <br />or portion thereof, which does not create individual lots for which a building permit may <br />be issued, including Assessor's Parcels that are designated as remainder parcels. <br />"Fiscal Year" means the period starting July 1 and ending on the following June 30. <br />"Hotel Property " means 2.83 acres of Developed Property located within Lot 1 as <br />depicted for hotel /retail on One Marina Vesting Tentative Map approved by Redwood <br />City Planning Commission on July 20, 2010 for which a building permit for the <br />construction of a place of lodging providing sleeping accommodations and related <br />facilities, including community serving retail, for travelers is intended to be issued by the <br />City. Furthermore, if Lot 1 described in the preceding sentence is subsequently <br />changed or modified by recordation of a lot line adjustment or similar instrument, and <br />only if the CFD Administrator determines that such change or modification results in a <br />decrease in the Acreage of Lot 1 to below 2.83 acres, then for purposes of this Rate <br />and Method of Apportionment the sum of the Acreage for all newly created parcels <br />affected by such lot line adjustment or similar instrument shall be equal to 2.83 acres <br />and computed as follows: (a) determine the Acreage for each lot created by such lot line <br />adjustment or similar instrument for which building permits may or have already been <br />issued (a "Buildable Lot "), (b) divide the Acreage for each newly created Buildable Lot <br />by the aggregate Acreage of the Buildable Lots calculated in part "a" to determine the <br />percentage of the aggregate Acreage to be allocated to such lots, and (c) multiply the <br />percentages(s) computed in part "b" by the aggregate Acreage of the original Lot 1 to <br />determine the number of acres for each Buildable Lot. <br />"Indenture " means the indenture, fiscal agent agreement, resolution or other <br />instrument pursuant to which CFD No. 2010 -1 Bonds are issued, as modified, amended <br />and /or supplemented from time to time. <br />"Land Use Class" means any of the classes listed in Table 1 and Table 2, below. <br />"Location" means Marina View Property or Non - Marina View Property as defined in <br />this Section A. <br />"Marina Property" means all property located within Lot 4 as depicted for existing <br />preserved marina basin on One Marina Vesting Tentative Map approved by Redwood <br />City Planning Commission on July 20, 2010. <br />"Marina View Property" means all Residential Property that have (i) front, rear, or side <br />yard frontage along the Marina Property, or (ii) direct front door access to the Marina <br />Property. <br />"Maximum Special Tax" means the maximum Special Tax, determined in accordance <br />with Section C herein, that can be levied in any Fiscal Year on any Assessor's Parcel of <br />Taxable Property. <br />"Non- Marina View Property" means all Residential Property that is not Marina View <br />Property. <br />#15048 <br />MUFF # 506 <br />
