. . 1 aforesaid improvements to Massachusetts Avenue, as shown on 2 attached Exhibit "A", and shall be computed as follows: 3 (a) Roadwork Construction Costs: CITY's obligation for 4 costs inherent to all roadwork on Massachusetts Avenue, 5 estimated to be $4,800, shall be the actual cost to STATE 6 under the terms of an executed contract change order between 7 STATE and STATE's contractor, said c9nstruction.costs will 8 be determined by multiplying the final pay quantities 9 required for C~TY's po~tion of aforesaid improvements by contract unit,prices in STATE's construction contract. (b) Preliminary and Construction Engineering Cost~: 10 11 . , 12 CITY's 'obligation for such costs, estimated to be $1,050, 13 . shall be an amount representing twenty-two percent (22%) of 14 af6resaid actual construction eosts, which amount includes 15 all direct and indirect costs attributable to such work. 16 2.) To acquire at CITY's sole expense all rights of way 17 required for the aforesaid improvements to Mas'sachusetts Avenue. 18 3~) To furnish evidence to STATE prior to March 20, 1970} 19 in, a form acceptable to STATE that: 20 (a) All such rights of way have been acquired or that 21 c6ndemnation proceedings have been filed involving any 22, unacquired parcel or parcels. 23 (b) CITY has secured all necessary court orders for 24 immediate possession of any unacquired parcel or parcels and 25 will prosecute to completion, as soon thereafter as possible, 26 all court proceedings for the acquisition of any such parcels ,27 -}(. * ~- * * * * -7-
