6.2A <br /> REP4RT <br /> To the Honorable Mayor and City Council <br /> From the City Manager ; <br /> August 23, 2010 <br /> SUBJECT <br /> Final Acceptance—885 Woodside Road Subdivision Improvements <br /> RECOMMENDATION <br /> Accept, by motion, the construction improvements for the 885 Woodside Road <br /> Subdivision, and release the bonds according to City procedures in accordance with the <br /> Subdivision Agreement. <br /> BACKGROUND <br /> On January 12, 2010, Council approved the Agreement for construction improvements <br /> at the 885 Woodside Road Subdivision. The City-approved subdivision required the <br /> developer to make street and other related improvements inc[uding paving, drainage, <br /> water, sewer, landscaping and landscape irrigation. Separately, under the building <br /> permit, 43 condominiums were built. <br /> The developers, Nicholson-Lamb Ventures, LP, have completed the construction of <br /> improvements in accordance with the Agreement, the plans and specifications, and to <br /> the satisfaction of the Building, Infrastructure & Transportation Department. <br /> The developers provided a faithful performance bond and a labor and material bond, <br /> each in the amount of $113,804.00 each which can be released at this time. These <br /> bonds will be replaced by a maintenance bonds in the amount of $11,380.00 (10%) <br /> which will be held for a period of 1 year. This bond is a warranty in case any of the <br /> improvements fait within the period. <br /> ALTERNATIVES <br /> Council may choose not to accept the construction improvements which would be <br /> contrary te �he provisi�ns in �he Agi-��rr�rt <br /> FIS�C�1L.
