6.1 E <br /> ATTACHMENT P�e 5 <br /> AMENDMENT NO. 1 TO LICENSE AGREEMENT <br /> (HD Food Service Inc. <br /> License Area 1A— 2202 Broadway) <br /> TH1S AMENDMENT N�. 1 is entered into as of , 2010, amending <br /> the license agreement dated June 26, 2009 (the "Original License Agreement"} by and <br /> befinreen the City of Redwood City, a chartered municipal corporation ("Licensor") and <br /> HD Food Service Inc., doing business as "Hidden Dragon Tea House", hereinafter <br /> referred to as "Licensee", (collectively the "Parties"). <br /> RECITALS <br /> WHEREAS, Hidden Dragon Tea House strives to sustain its presence at <br /> Courthouse Square; and <br /> WHEREAS, HD Food Service Inc. requests a rent reduction in order to continue <br /> to serve Redwood City residents and downtown visitors; and <br /> WHEREAS, the City desires to assist Hidden Dragon Tea House in its efforts to <br /> main#ain a business presence at Courthouse Square; and <br /> WHEREAS, the Parties have negotiated and agreed to the following <br /> amendments to the �riginal License Agreement. <br /> NOW THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. Paragraph 3, Sections 3.1 is hereby amended to read as follows: <br /> 3. "LICENSE PAYMENTS <br /> 3.1 License Fee. The monthly license fee to be paid to the Licensor shall be six <br /> cents ($0.06) per square foo# per month for a total of $81.72. Licensee shall pay to <br /> Licensor the monthly license fee beginning on May 1, 2011. License fees shall be <br /> payable in advance, on or before the first day of each and every month of the License <br /> Term." <br /> 2. Section 21 is hereby amended to read as follows: <br /> 21.
