Third Partv Beneficiarv, This Agreement including, but not limited to, <br /> indemnification provisions, is for the benefit of the Parties only and does not create, nor <br /> is it intended to create, any benefit or liability to third parties. The failure of either Party to insist upon the strict <br /> performance of any of the terms, conditions or co�enants in this Agreement shall not be <br /> deemed a waiver of any right or remedy that either Party may have and shall not be <br /> deemed a waiver of any right or remedy for a subsequent breach or default of the terms, <br /> conditions or covenants herein contained. <br /> 15. Authoritv. The Parties each warrant and represent to the other that they <br /> have the full legal authority to enter into this Agreement. <br /> 16. Entire Aqreement. This Agreement sets forth the entire agreement <br /> between the Parties and any modifications or extensions must be in the form of a <br /> written amendment fully noticed and approved. <br /> 17. Equal EmploVment Opportunity. In connection with the pertormance of <br /> this Agreement, neither City nor District shall discriminate against any employee or <br /> applicant for employment because of race, religion, color, sex, physical or mental <br /> disability, age, sexual orientation, or national origin. City shall comply with Section 504 <br /> of the Rehabilitation Act of 1973, which provides that no otherwise qualified <br /> handicapped individual shall, solely be reason of a handicap, be excluded from <br /> participation or be denied the performance of this Agreement. <br /> ATTY/AGR/209 0.029 6 <br /> 041410 <br />
