6.11 <br /> Page 1 <br /> REPQRT <br /> To the Honorable Mayor and City Council <br /> From the Ci Mana er <br /> August 23, 2010 <br /> SUBJECT <br /> Professional Services for the Laurel Way Environmental Impact Report (ElR) <br /> RECOMMENDATION <br /> Approve by motion Amendment No. 2 to the Agreement with MHA/RMT, Inc. (MHA), to finalize <br /> the preparation of the EIR for the Laurel Way project (Attachment 1). <br />, BACKGROUND <br /> The Laurel Way Joint Venture, which is comprised of 18 of the 19 property owners who own <br /> vacant parcels located at the western end of Laurel Way, is proposing to develop the remaining <br /> undeveloped 18 parcels with individual single family homes.The project site is apprvximately 5.1 <br /> acres in area. <br /> Per City Councii policy, an Environmental Impact Report (including alf necessary technical <br /> studies) is required to be prepared prior to any new development at the western end of Laurel <br /> Way. The EIR will examine the full build-out of a new private street, and provide comprehensive <br /> information (e.g. engineering, geology, biofogy, and other studies} necessary to guide the <br /> proposed residentia! development on Laurel Way. A Planned Development Permit and <br /> Tentative Subdivision Map applications have also been filed by the Laurel Way Joint Venture. <br /> The City executed the original agreement for the EIR for$159,812 (plus �15,912 contingency <br /> fund) in 2008 and Amendment No. 1 in 2009. Although with Amendment No. 1 the consultant <br /> committed to complete the EIR, additional scope is now needed for the Final EIR to address <br /> certain topics in greater depth. Amendment No. 2 covers additional work including the gathering <br /> and processing of new data, additional research, participating in extra rneetings and finalizing the <br /> EIR, in the amount of$27,248.90. The applicant has agreed to this modification. <br /> A brief history of this Agreement and associated amendments is summarized below: <br /> • April 2008: Original Agreement for $159,812.00. <br /> • May 2009: Amendment No.1 submitted for$46,863.00 for additional tasks to complete the <br /> Environmental Impact Report. <br /> • July 2010: Amendment No. 2 submitted for $27,248.90 to finalize the EIR. <br /> • To date, the ElR consultant and contract planner/staff have completed the following tasks: <br /> o Drafted a project description and definition; <br /> o Prepared and analyzed technica) reports; <br /> o Conducted additional peer reviews; <br /> o Prepared impact sections of the EIR (i.e. cultural resources, hydrology, noise and <br /> traffic); and, <br /> o Presented the Planning Commission with the Draft EIR (DEIR) for comments in <br /> April 2010. <br />
