<br />INSTALLATION AND REMOVAL OF FACILITIES
<br />AND SUPPLY OF TEMPORARY ELECTRIC SERVICE

<br />hereinafter called Customer, Pacific Gas and Electric Company, hereinafter called Pacific, hereby agrees to install electric facilities
<br />without undue delay and to sell and deliver to Customer by means thereof temporary electric service subject to the terms and condi-
<br />tions hereinafter provided:
<br />
<br />1. Customer shall pay to Pacific, on demand, S 4., Q03 ?O ,which is the agreed estimated cost of installing and later
<br />removing said facilities. in the way stated on the cover let ter.
<br />
<br />2. Said facilities shall at all times be and remain the property of Pacific and Pacific shall have a reasonable time to remove
<br />same following termination of service under this agreement.
<br />
<br />3. Pacific shall sell and deliver to Customer, and Customer shall purchase and receive from Pacific, all electric service re-
<br />
<br />quired for the operation of Customer's electrical machinery and apparatus consisting of: NOTle (Seruj C'e 1iJj 1 1 ne de] i'\Tered

<br />located upon property owned, leased or under license to
<br />Customer at Redwood Shores Ill. City of Redwood City
<br />State of California, all in accordance with Pacific's applicable rates and rules legally established from time to time and on file with
<br />the Public Utilities Commission of the State of California.
<br />
<br />4. If service to said electrical machinery or apparatus or its equivalent is supplied to Customer on a continuous, intermittent or
<br />seasonal basis for a period of thirty six (36) consecutive months from the date of first- service hereunder, Customer shall be classified
<br />as permanent, and that portion of the paymer.t made by Customer under Section 1 above which is in excess of the payment which would,
<br />have been required for permanent service under Pacific's extension rule in effect at the time of first service hereunder shall be re-
<br />funded to Customer at the rate of 1-2/3% for each month of service in excess of the first twelve (12) months, provided that Customer
<br />then complies with all of Pacific's rules applicable to electric service. Refunds shall be made annually except when a partial year's
<br />refund may be required upon termination of service.
<br />
<br />S. If at any time the character of Customer's operations changes so that in Pacific's sole opinion Customer may be classified
<br />as permanent, that portion of the payment made under Section 1 above which is in excess of that which would have been required for
<br />permanent service will be refunded to Customer upon reclassification from temporary to permanent on the basis of Pacific's extension
<br />rule in effect at the date of first service hereunder.
<br />
<br />6. Total refunds shall not exceed the amount paid by Customer for installing and late~ removing said facilities and no interest
<br />shall be paid on such amount.
<br />
<br />7. In no event will Customer be classified as temporary for more than six years.
<br />
<br />8. Customer hereby grants to Pacific all necessary rights-of-way and easements over property owned, leased or under license to
<br />Customer along the shortest practicable route thereon, and of suffici~nt width to provide full legal clearances from all structures now
<br />or hereafter erected therealong, for any pole and wire line required to make delivery of electric service hereunder. Whenever part or
<br />all of said facilities are to be installed upon property owned by other than Customer, Customer shall, if Pacific is unable to do so,
<br />first procure from the owners thereof, in the name of Pacific, all rights-of-way and easements necessary for the construction, mainte-
<br />nance and operation of said facilities upon such other property, which rights-of-way and easements shall be satisfactory to Pacific
<br />and without cost to it. If it is impossible (or impracticable) for Pacific or Customer to obtain rights-of-way and easements satisfactory
<br />to Pacific, Pacific shall not be obligated to render service hereunder. Pacific may, however} without being required so to do, locate
<br />any of its facilities required to supply service hereunder on property across which suitable permanent rights-of-way and easements
<br />are not available on a basis acceptable to Pacific, and should Pacific's license or permission to locate facilities on such property
<br />be revoked or terminated Pacific shall have the right to remove or abandon its facilities and discontinue electric service hereunder
<br />without liability.
<br />
<br />9. All electricity delivered hereunder shall be what is commonly designated as
<br />
<br />current and shall be delivered and metered at an electro-motive force of approximately
<br />frequency and electro-motive force to be allowed. -

<br />10. Customer shall pay Pacific monthly for said service at any' established office of Pacific at the rates and charges applicable
<br />thereto. The presently applicable rates and charges are set forth in Schedule No. ~ hereby selected by Customer, a copy of
<br />which is hereunto annexed and made a part hereof.
<br />
<br />11. Customer may, with Pacific's written consent, assign this agreement if the assignee thereof will, in writing, agree to perform
<br />Customer's obligations hereunder. Such assignment, unless otherwise provided therein, shall be deemed to include Customer's right
<br />to any refunds then unpaid or which may thereafter become payable hereunder.
<br />
<br />12. Delivery of electricity hereunder by Pacific shall be at the point where wires owned, leased or under license by Customer
<br />contact Paciiic's wires, but for the convenience of the p'arties hereto said electricity may be transformed and/or metered at such
<br />location on the Customer's side of said point of delivery as shall be agreed upon by the parties hereto.
<br />

<br />14. This agreement shall at all times be subject to such changes or modif(cations by the Public Utilities Commission of the
<br />State of California as said Commission may from time to time direct in the exercise of its jurisdiction.
