DES:yc:I0/9/69 <br /> ORIGINAL <br /> OCT 1 3 '69 <br /> RES 0 L UTI 0 N N O. ,/;)., <br /> ---------- <br /> <br />RESOLUTION AUTHORIZING ATTORNEY GENERAL OF THE STATE <br />OF CALIFORNIA TO INSTITUTE LEGAL PROCEEDINGS FOR <br />DAMAGES AND OTHER LEGAL RECOVERY RELATING TO CONSPIRACY <br />TO RETARD THE INTRODUCTION OF SMOG CONTROL DEVICES <br /> <br />WHEREAS, the Attorney General of the state of California <br /> <br />has requested authorization of the City of Redwood City to join <br /> <br />said City as a party to legal proceedings seeking recovery <br /> <br />against certain automobile manufacturers for conspiring to <br /> <br />retard the introduction of smog control devices in the State <br /> <br />of California; and <br /> <br />WHEREAS, it is the desire of this Council to authorize the <br /> <br />institution of such proceedings for and on behalf of the City <br /> <br />of Redwood City; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. That the Attorney General of california, or any of his <br /> <br />authorized assistants or deputies, be authorized to take such <br /> <br />action on our behalf and in our name, as, in his sole discretion, <br /> <br />may be deemed appropriate to the preparation, filing, service <br /> <br />and prosecution or a civil Antitrust Suit for damages and other <br /> <br />legal recovery against certain automobile manufacturers for <br /> <br />conspiring to retard the introduction of smog control devices <br /> <br />in the state of California. <br /> <br />2. That this authorization includes the authority to settle <br /> <br />such litigation on such terms as the Attorney General or any of <br /> <br />his authorized assistants or deputies may deem appropriate, and <br /> <br />to allocate to us our proper and equitable share of any sum <br /> <br />recovered as damages excepting the amount of attorneys' fees, <br /> <br />costs, and expenses incurred by the Attorney General, as <br />
