subcontractors. The insurance will be obtained from an insurance carrier admitted and authorized to do business in the State of California. The insurance carrier is required to have a current Best's Key Rating of not less than "A-:V." 16.1 Coveraoes and Limits. Performer will maintain the types of coverages and minimum limits indicated below, unless Risk Manager or Executive Director, in consultation with the General Counsel, approves a lower amount. These minimum amounts of coverage will not constitute any limitations or cap on Performer's indemnification obligations under this Agreement. Agency and/or City, their officers, agents, volunteers and employees make no representation that the limits of the insurance specified to be carried by Performer pursuant to this Agreement are adequate to protect Performer. If Performer believes that any required insurance coverage is inadequate, Performer will obtain such additional insurance coverage, as Performer deems adequate, at Performer's sole expense. 16.1.1 Commercial General Liability Insurance. $1,000,000 combined single-limit per occurrence for bodily injury, personal injury and property damage. If the submitted policies contain aggregate limits, general aggregate limits will apply separately to the work under this Agreement or the general aggregate will be twice the required per occurrence limit. 16.1.2 Business Automobile Liability Insurance. Business automobile liability insurance policy which provides coverage at least as broad as ISO form CA 00 01 with policy limits a minimum limit of not less than one million dollars ($1,000,000) each accident using, or providing coverage at least as broad as, Insurance Services Office form CA 00 01. Liability coverage shall apply to all owned, non-owned and hired autos. In addition to the Performance Fee as set forth in Section 4 of the Agreement entitled "Live Performance Agreement," the Agency shall pay, as additional compensation, the cost of procuring the Business Automobile Liability coverage described above and purchased in order to cover these Performances, and such cost shall not exceed one thousand dollars ($1,000). 16.1.3 Workers' Compensation and Employer's Liability. Workers' Compensation limits as required by the California Labor Code and Employer's Liability limits of $1,000,000 per accident for bodily injury. Workers' Compensation and Employer's Liability insurance will not be required if Performer has no employees and provides, to Agency's satisfaction, a declaration stating this. 16.2.
