/1,133 -2 <br />It is recommended that the City of Redwood City initiate eminent domain proceedings to <br />acquire the above - entitled property by adopting the attached Eminent Domain Resolution. <br />The acquisition is for the approximately 590 space underground parking facility in the <br />downtown area. The property is identified on the exhibits attached to the Resolution of <br />Necessity. The Resolution of Necessity requires an affirmative two- thirds vote of the City <br />Council for passage, which numerically equates to 5 of 7 Council Members. <br />The property is located at 870 Jefferson Avenue. The subject property consists of a one - <br />story retail building constructed in 1946 of approximately 3,440 square feet on the first floor <br />with a second floor mezzanine of 579 square feet adjacent to an accessible attic space <br />(with a low ceiling height) of 400 square feet on a 3,604 square foot parcel. The appraisal <br />of the improvements was based on an exterior and partial interior inspection (i.e., interior <br />access could not be obtained from the owner's Attorney) of the building and reliable <br />information from the City concerning the size of the building, interior and exterior <br />improvements with every benefit to the owner. The description of the improvements from <br />the City's Appraisal is attached as Exhibit "A ". <br />It is necessary that this parcel be acquired by the City for the construction of an <br />approximately 590 space underground public parking facility for the downtown area. The <br />proposed project is for the purposes of public parking. <br />The public use and necessity for the project is public parking, an established public use <br />under the law. The proposed project will serve to provide public parking, which will help <br />improve the downtown area and the Project's goal of providing downtown public parking. <br />(Copies of all reports, studies and environmental documents are available for review at the <br />City Clerk's office, and are incorporated into the administrative record herein by this <br />reference. <br />The City has previously prepared, circulated and certified a Final Environmental Impact <br />Report (EIR) and Addendum to the EIR, together with other environmental documents in <br />compliance with the environmental review process under the California Environmental <br />Quality Act ( "CEQA "), found in Public Resources Code Sections 21000, et. seq., and the <br />State CEQA Guidelines adopted by the Secretary of Resources. <br />Administrative Record In addition to this staff report and its attachments, the City Council <br />is referred to the aforementioned environmental review documents, together with all other <br />reports, studies, orders, decisions and writings, which form the administrative record forthe <br />Project, all of which are incorporated herein by this reference, made a part hereof and may <br />be relied upon by the City Council in making its decision. <br />Negotiations /Acquisition Procedure The staff has attempted to reach an agreement with <br />the owners on the terms and conditions for the voluntary sale of the property. However, <br />agreement for that sale has not been reached at this time. It is now appropriate to <br />consider eminent domain proceedings in order to meet the Project schedule. <br />Under State law procedures, a hearing is held by the Council prior to initiating eminent <br />domain proceedings. The hearing is for the limited purpose of whether to adopt the <br />Resolution of Necessity, which entails a consideration of the following four items: <br />-2- <br />
