/O„S/- z <br />The acquisition is for the approximately 590 space underground parking facility in the <br />downtown area. The property is identified on the exhibits attached to the Resolution of <br />Necessity. The Resolution of Necessity requires an affirmative two - thirds vote of the City <br />Council for passage, which numerically equates to 5 of 7 Council Members. <br />The property is located at 2117 Broadway. The subject property consists of a two story <br />office /retail building constructed in approximately 1950 consisting of approximately 22,442 <br />rentable square feet on a 27,503 square foot parcel located at the comer of Broadway and <br />Middlefield with six tenants, including one local Social Security Office. <br />It is necessary that this parcel be acquired by the City for the construction of an <br />approximately 590 space underground public parking facility for the downtown area. The <br />proposed project is for the purposes of public parking. <br />The public use and necessity for the project is public parking, an established public use <br />under the law. The proposed project will serve to provide public parking, which will help <br />improve the downtown area and the Project's goal of providing downtown public parking. <br />(Copies of all reports, studies and environmental documents are available for review at the <br />City Clerk's office, and are incorporated into the administrative record herein by this <br />reference. <br />The City has previously prepared, circulated and certified a Final Environmental Impact <br />Report (EIR) and Addendum to the EIR, together with other environmental documents in <br />compliance with the environmental review process under the California Environmental <br />Quality Act ( "CEQA "), found in Public Resources Code Sections 21000, et. seq., and the <br />State CEQA Guidelines adopted by the Secretary of Resources. <br />Administrative Record In addition to this staff report and its attachments, the City Council <br />is referred to the aforementioned environmental review documents, together with all other <br />reports, studies, orders, decisions and writings, which form the administrative record for the <br />Project, all of which are incorporated herein by this reference, made a part hereof and may <br />be relied upon by the City Council in making its decision. <br />Negotiations /Acouisition Procedure The staff has attempted to reach an agreement with <br />the owners on the terms and conditions for the voluntary sale of the property. However, <br />agreement for that sale has not been reached at this time. It is now appropriate to <br />consider eminent domain proceedings in order to meet the Project schedule. <br />Under State law procedures, a hearing is held by the Council prior to initiating eminent <br />domain proceedings. The hearing is for the limited purpose of whether to adopt the <br />Resolution of Necessity, which entails a consideration of the following four items: <br />1. Whether the public interest and necessity require the project; and <br />2. That the project is planned or located in a manner that will be most compatible with <br />the most public good and least private injury; and <br />dZ <br />
