CALIFORNIA 94010 <br />TELEPHONE 16501346 -5195 <br />FACSIMILE X6501346 -3518 <br />The following memorandum sets forth the procedures for the adoption of the Resolution of <br />Necessity authorizing the acquisition of the above - entitled property by eminent domain. <br />First, the law requires that the City send a written notice, by fast class mail, to each person whose <br />property is to be acquired by eminent domain and whose name and address appears on the last equalized <br />county assessment roll of the Council's intention to adopt a Resolution of Necessity regarding those <br />proceedings. <br />Second, the Council must adopt the Resolution of Necessity determining that the public interest <br />and necessity require the acquisition of such property and directing the filing of eminent domain action. <br />To comply with the law, a Notice of Intention to Adopt a Resolution of Necessity has been <br />prepared and forwarded to the property owners advising the owners of the hearing wherein the City <br />Council will consider the adoption of the Resolution of Necessity. No Council authority is needed to <br />send this Notice. It is a requirement of the Eminent Domain statutes. <br />At the hearing on the Resolution of Necessity, the Council will hear all persons whose property is <br />to be acquired speak in relation to the adoption of the Resolution of Necessity and the directing of the <br />filing of an eminent domain action for the acquisition of the property for the public parking facility <br />project. Please note that this is not a public hearing. The Council is only required to hear those persons <br />to whom the Notice of Intention has been mailed and who have filed a timely request to be heard as <br />specified in the Notice. However, it is within the Council's authority to hear any owner, or, in fact, anyone <br />else, who requests to speak even though no letter request has been timely filed with the Council. <br />
