SCJP~ <br /> <br />MAY 12 .00 <br /> <br />RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY FINDING <br />AND DETEill1INING T}L~T THE PUBLIC IIITEREST AND NECESSITY REQUIRE <br />THE ACQUISITION A~D CONSTRUCTION BY THE CITY OF REDHOOD CITY OF <br />A PUBLIC IMPROVEMENT, NAMELY, A PUBLIC S'rREET, IN AND UPON THAT <br />CERTAIN REAL PROPERTY HEREIN DESCRIBED: THAT THE ACQUISITION OF <br />A RIGHT OF WAY AND EASEMENTS IN SAID REAL PROPERTY HEREIN <br />DESCRIBED IS NECESSARY FOR SAID PUBLIC IMPROVEMENT: AUTHORIZING <br />THE CITY ATTORNEY TO BRING JI..N ACTION IN EHINENT DOi'1AIN TO <br />ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC INPROVEHENT AND TO <br />APPLY FOR AN ORDER OF IIvlHEDLZ\TE POSSESSION OF SAID REAL <br />PROPERTY; AND AUTHORIZING AND DIRECTING THE CITY ~~NAGER TO <br />DEPOSIT HONEY FOR II-Uv'tr:::DIATE, POSSESSION OF SAID REAL PROPERTY <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE, CITY OF REDWOOD CITY, AS FOLLOWS: <br /> <br />That it hereby finds and determines and declares: <br /> <br />That the public interest and necessity require the acquisition and <br /> <br />construction by the City of Redwood City of a public improvement, namely, <br /> <br />a public street and appurten~nces, in and upon that certain real 'property <br /> <br />hereinafter described: <br /> <br />That the acquisition by the City of Redwood City of a right of way <br /> <br />and easements in and upon that certain real property hereinafter descrj~ed <br /> <br />is necessary for said public improvement: <br /> <br />That said public improvement is the use to which said real property <br /> <br />is to be applied, and that said use is a public use authorized by law; <br /> <br />That said pUb,lic improvement is planned and located in the manner <br />which will be most compatible with the greatest public good and the least <br /> <br />private injury; <br /> <br />AND, BE IT FURTHER RESOLVED: <br /> <br />That the City of Redwood City acquire said right of way and easements <br /> <br />in and upon said real property for said public improvement by an action in <br /> <br />eminent domain in accordance with the provisions of the Charter of the <br /> <br />City of Redwood City, the provisions of Article I, Section 14, of the <br /> <br />Constitution of the state of California, and the provisions of the Code <br /> <br />of civil Procedure of the State of California relating to eminent domain, <br /> <br />said real property and easements being more particularly described as follow: <br /> <br />A perpetual easement and right of way for street purposes and for <br />public 'utility purposes, including the right to excavate; install, <br />replace (of the initial or any other size), maintain, repair and <br />use such street and utility facilities, together with appurtenances <br />thereto, as the City of Redwood City shall from time to t~ne elect, <br />within the real property situate in the City of Redwood City, <br />County of San Mateo, state of California, more particularly described <br />as follows:~- <br />
