SAID PUBLIC IMPROVEMENT AND TO APPLY FOR AN ORDER OF I~1EDIATE POSSESSION OF SAID R}~L PROPERTY; AND AUTHORIZ ING AND D IRE err ING THE CITY t-'L.Ll.NAGER TO DEPOSIT HONEY FOR Il''lHEDIATE POSSESSION OF SAID REAL PROPERTY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: That it hereby finds and determines and declares: That the public interest and necessity require the acquisition and That the acquisition by the City of Redwood City of a right of way and easements in and upon that certain real property hereinafter described is necessary for said public improvement; That said'public improvement is the use to which said real property is to be applied, and that said use is a public use authorized by law; That said public improvement is planned and located in the manner which will be most compatible with the greatest public good and the least private injury; AND, BE IT FURTHER RESOLVED: That the City of Redwood City acquire said right of way and easements in and upon said real property for said public improvement by an action in eminent domain in accordance with the provisions of the Charter of the City of Redwood City, the provisions of Article I, section 14, of the Constitution of the state of California, and the provisions of the Code of Civil Procedure of the State of California relating to eminent domain, said real property and easement.s being more, partic'ularly described as follow~ A perpetual easement and right of way for street purposes and for public utility purposes, including the right to excavate, install, replace (of the initial or any other size), maintain, repair and use such street and utility facilitie~, together with appurtenances thereto, as the City of Red':lood City shall from time to time elect, within the r~al property situ~te in the City of Redwood City, County of ~an Mateo, state of California" more particularly described as follows: ~
