SJ' 9..3 <br /> <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY <br /> <br />BEL AIR WAY IMPROVEMENTS <br /> <br />ORIGINAL <br /> <br />FEB 10 'Gi <br /> <br />WHEREAS, on January 20, 1969, the Council of the City of <br />Redwood City adopted a resolution of preliminary determination <br />to make public improvements in the City of Redwood City, being <br />Resolution No. 5879 of said Council, to construct certain public <br />improvements more particularly described therein, and did fix there- <br />in this date as the time and place when and where any and all per- <br />sons interested may appear and show cause, if any they have, why <br />the City Council should not find and determine that the public con- <br />venience and necessity require the improvements described and re- <br />ferred to in said resolution without compliance with the Special <br />Assessment, Investigation, Limitation and Majority Protest Act of <br />1931; and, <br /> <br />WHEREAS, notice of the adoption of said resolution and of said <br />time and place of hearing was given by the City Clerk by publication <br />and posting for the time and in the manner provided in said resolu- <br />tion and Article II of Chapter 18 of the' Redwood City Code, as ap- <br />pears from the affidavits on file with the City Clerk; and, <br /> <br />WHEREAS, no persons objecting to the undertaking of said pro- <br />ceedings without first complying with the provisions of said Special <br />Assessment, Investigation, Limitation and Majority Protest Act of <br />1931 have filed written objections thereto with the City Clerk at or <br />before the time fixed for this hearing by persons interested, owning <br />or having an interest in real property within the proposed assess- <br />ment district, bearing their signatures, a description of their <br />property, and a statement of the nature of their interest therein; <br />, and, <br /> <br />WHEREAS, all persons have been given an opportunity to be and <br />were fully heard, and said Council has duly considered any and all <br />objections and protests made, and the said proposed improvements and <br />the public convenience and necessity for making the sam~; <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF REDWOOD <br />CITY, AS FOLLOWS: <br /> <br />1. That the public convenience and necessity require the <br />improvements described in said Resolution No. 5879. <br /> <br />2. That any and all objections and protests made pursuant <br />to said resolution be, and the same are, hereby over- <br />ruled and denied. <br /> <br />3. That the improvements described in said resolution be <br />made under and pursuant to the provisions of the Im- <br />provement Act of 1911 as embodied in the Streets and <br />Highways Code of the State of California, as amended, <br />and that the Special Assessment, Investigation, Limi- <br />tation and Majority Protest Act of 1931 shall not apply <br />to said proceedings. <br /> <br />* * * * * * * * <br />
