SJ' 9..3 RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY BEL AIR WAY IMPROVEMENTS ORIGINAL FEB 10 'Gi WHEREAS, on January 20, 1969, the Council of the City of Redwood City adopted a resolution of preliminary determination to make public improvements in the City of Redwood City, being Resolution No. 5879 of said Council, to construct certain public improvements more particularly described therein, and did fix there- in this date as the time and place when and where any and all per- sons interested may appear and show cause, if any they have, why the City Council should not find and determine that the public con- venience and necessity require the improvements described and re- ferred to in said resolution without compliance with the Special Assessment, Investigation, Limitation and Majority Protest Act of 1931; and, WHEREAS, notice of the adoption of said resolution and of said time and place of hearing was given by the City Clerk by publication and posting for the time and in the manner provided in said resolu- tion and Article II of Chapter 18 of the' Redwood City Code, as ap- pears from the affidavits on file with the City Clerk; and, WHEREAS, no persons objecting to the undertaking of said pro- ceedings without first complying with the provisions of said Special Assessment, Investigation, Limitation and Majority Protest Act of 1931 have filed written objections thereto with the City Clerk at or before the time fixed for this hearing by persons interested, owning or having an interest in real property within the proposed assess- ment district, bearing their signatures, a description of their property, and a statement of the nature of their interest therein; , and, WHEREAS, all persons have been given an opportunity to be and were fully heard, and said Council has duly considered any and all objections and protests made, and the said proposed improvements and the public convenience and necessity for making the sam~; NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF REDWOOD CITY, AS FOLLOWS: 1. That the public convenience and necessity require the improvements described in said Resolution No. 5879. 2. That any and all objections and protests made pursuant to said resolution be, and the same are, hereby over- ruled and denied. 3. That the improvements described in said resolution be made under and pursuant to the provisions of the Im- provement Act of 1911 as embodied in the Streets and Highways Code of the State of California, as amended, and that the Special Assessment, Investigation, Limi- tation and Majority Protest Act of 1931 shall not apply to said proceedings. * * * * * * * *
