<br />3. Compensation. Fire JP A shall be compensated for providing Shared Fire Marshal <br />services as follows: <br />a. At the designated employee's hourly rate which is defined as the ordinary <br />compensation and benefits cost the Fire JP ~~ays its designated employee. <br />The current hourly rate of Jim Palisi is $q]Yf If, during the term of this <br />Agreement, an alternate employee is designated by the Fire JP A or the <br />designated employee's hourly rate changes, the revised hourly rate of that <br />employee shall be applicable. <br />b. In the event of termination of this Agreement by either City or Fire JP A, City <br />shall be entitled to payment for the services performed as of the date of <br />termination. <br />c. The Shared Fire Marshal shall be on call for the City, just as he is for the Fire <br />JP A. If called out between the hours of 1160 and ,) roo or on week-ends, for <br />the Fire JP A will bill for travel time, investigation time and up to four hours to <br />complete the written investigation, which the Shared Fire Marshal shall <br />deliver to the City Chief within 96 hours of leaving the scene of the <br />investigation. <br />d. Vehicle Usage. The Fire JP A shall provide the Fire Marshal with a vehicle <br />for transportation usages, i.e.: Movement of equipment, meetings, emergency <br />response and as deemed necessary. <br /> <br />4. Payment. Fire JP A shall submit monthly billings to City reflecting the hours worked <br />by the Shared Fire Marshal per this Agreement. The costs for these hours will be <br />credited toward the costs of Joint Training Officer services provide to the Fire JP A by <br />City. If, during the term of this Agreement, the cost of providing Shared Fire Marshal <br />services exceeds the value of Joint Training Officer services, City shall then be <br />obligated to issue payment to Fire JP A at the hourly rate for the Shared Fire Marshal. <br />Payments shall be received within thirty (30) days of billings. <br /> <br />5. Employment of Personnel. Notwithstanding the above, the designated Shared Fire <br />Marshal shall not be deemed a City employee for any purpose. Fire JP A shall be <br />solely responsible for all salary, benefits, workers' compensation and insurance for <br />the designated Shared Fire Marshal and the designated Shared Fire Marshal shall be <br />considered an employee of Fire JP A for all supervisory, disciplinary and other <br />employment related purposes. <br /> <br />6. Litigation Support. Fire JP A will make the designated Shared Fire Marshal available <br />to testify in any litigation or administrative proceeding brought regarding work <br />performed under this Agreement. <br /> <br />a. Should City request that the designated Shared Fire Marshal testify in any <br />litigation or administrative hearing following the termination of this <br />Agreement, City shall compensate Fire JP A for its costs and expenses for <br />
