<br />RESOLUTION NO. <br /> <br />RESOLUTION BY THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY CONFIRMING PROCLAMATION OF THE EXISTENCE OF A <br />LOCAL EMERGENCY AND RATIFYING THE CITY MANAGER'S <br />IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD <br />LIFE, HEALTH, PROPERTY AND ESSENTIAL PUBLIC SERVICES <br /> <br />WHEREAS, Section 10.5 of the Redwood City Municipal Code designates the <br /> <br />City Manager to be the Director of Emergency Services; and <br /> <br />WHEREAS, Section 10.6 (A) of the Redwood City Municipal Code empowers the <br /> <br />Director of Emergency Services to proclaim the existence or threatened existence of a <br /> <br />local emergency when the City is affected or likely to be affected by a public calamity <br /> <br />and the City Council is not in session; and <br /> <br />WHEREAS, Section 68 of the City Charter authorizes the City Council, in the <br /> <br />case of a great public calamity, such as extraordinary fire, flood, storm, epidemic, or <br /> <br />other disaster to adopt a resolution passed by a five-sevenths (5/7ths) vote, determining <br /> <br />and declaring that the public interest or necessity demands the immediate expenditure <br /> <br />of public money to safeguard life, health, or property, without soliciting or advertising for <br /> <br />bids; and <br /> <br />WHEREAS, upon adoption of the resolution, Section 68 of the City Charter <br /> <br />enables the City Council to expend, or enter into a contract involving the expenditure of, <br /> <br />any sum required in such emergency; and <br /> <br />WHEREAS, California Public Contract Code section 22050 more specifically <br /> <br />provides that the City Manager's authority to waive competitive bidding is triggered <br /> <br />A TTY IRESO/RESO.2049 <br />090710 <br /> <br />1 <br />
