DES:lm:7/23/68 ; RES 0 L UTI, 0 N ---------- N o. 5751 RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF REVOCABLE ENCROACHMENT PERMIT RELATING TO CONSTRUCTION AND MAINTENANCE OF RESIDENTIAL STRUCTURAL IMPROVEMENTS IN THE VICINITY OF LOT 9, BLOCK 4,. JEFFERSON ACRES SUB- SUBDIVISION WHEREAS, NICOLA and LOUISA Y. MARCHEGIANI, as owners of certain real property in the vicinity of Lot 9, Block 4, Jefferson Acres Subdivision, have requested permission to construct and maintain certain residential structural improvements within a portion, only, of the air space above a City-owned easement for storm drainage purposes and other public utilities; and WHEREAS, it is the intention and desire of this Council to grant a revocable encroachment permit permitting such construction, subject to certain designated terms and conditions; NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. That the City Manager is hereby authorized to execute a revocable encroachment permit to Nicola and Louisa Y. Marchegiani for construction and maintenance of residential structural improve- ments within a portion, only, of the air space above an easement for storm drainage purposes and other public utilities owned by the City of Redwood City within that certain real property situate in the City of Redwood City, County of San Mateo, State of California, more particularly described in Exhibit A of that certain revocable encroachment permit attached hereto and by this reference incor- porated herein, which permit shall not be effective until such time as Nicola and Louisa Y. Marchegiani execute an acceptance of its terms and conditions. 2. That the permit granted shall be in the form of that certain permit entitled "Grant of Revocable Encroachment Permit - Vicinity of Lot 9 of Block 4 of Jefferson Acres Subdivision," (form dated 7/22/68), attached hereto and incorporated herein as if set out at length herein. * * *
