RESOLUTION N0. 334_ RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY PIEDMONT WAY IMPROVEMENTS WHEREAS, on March 27, 1961, the Council of the City of Redwood City adopted a resolution of preliminary determination to make public improvements in the City of Redwood City, being Resolution No. 3341 of said Council, to construct certain public improvements more par- ticularly described therein, and did fix therein this date as the time and place when and where any and all persons interested may ap- pear and show cause, if any they have, why the City Council should not find and determine that the public convenience and necessity -Le- quire the improvements described and referred to in said resolution without compliance with the Special Assessment, Investigation, Limi- tation and Majority Protest Act of 1931; and WHEREAS notice of the adoption time and place of hearing was given tion and posting for the time and i n resolution and Ordinance No. 515 of appears from the affidavits on file of said resolution and of said by the City Clerk by publica- the manner provided in said the City of Redwood City, as with the City Clerk; and WHEREAS no persons objecting to the undertaking of said pro- ceedings without first complying with the provisions of said Special Assessment, Investigation, Limitation, and Majority Protest Act of 1931 have filed written objections thereto with the City Clerk at or before the time fixed for this hearing by persons interested, owning or having an interest in real property within the proposed assessment district, bearing their signatures, a description of their property, and a statement of the nature of their interest therein; and WHEREAS all persons have been given an opportunity to be and were fully heard, and said Council has duly considered any and all objections and protests made, and the said proposed improvements and the public convenience and necessity for making the same; NOW, THEREFORE, IT IS HEREBY RESOLVED BY the Council of Red- wood City, as follows: 1. That public convenience and necessity require the im- provements described in said Resolution No. 3341, 2. That any and all objections and protests made pursuant to said resolution be, and the same are, hereby overruled and denied. 3. That the improvements described in said resolution be made under and pursuant to the provisions of the Improvement Act of 1911 as embodied in the Streets and Highways Code of the State of California, as amended, and that the Special Assessment, Investigation, Limitation and Majority Protest Act of 1931 shall not apply to said proceedings.
