McCUNE, HELEN McCUNE, <br />AND RUTH SAWYER vs. CITY OF REDWOOD CITY; AND, <br />AUTHORIZING PAYMENT OF $2, 500 THEREFOR <br /> <br />WHEREAS, an action entitled "John W. McCune, Helen McCune <br /> <br />and Ruth Sawyer vs. City of Redwood City,.1 No. a0761, is presently <br /> <br />pending in the Superior Court of San Mateo County, California, <br /> <br />for damages alleged to have been suffered by plaintiffs as a <br /> <br />result of installation of certain street improvements by City; <br /> <br />and, <br /> <br />WHEREAS, plaintiffs in said action have offered to settle <br /> <br />said litigation in consideration of the payment to them of a <br /> <br />total sum of $2,500; and, <br /> <br />WHEREAS, it is the intention and desire of this Council to <br /> <br />approve such settlement and authorize the expenditure of the <br /> <br />necessary funds therefor; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> <br />AS FOLLOWS: <br /> <br />1. It is in the best interests of the City of Redwood City <br /> <br />that the abovementioned lit~gation be settled and the pending <br /> <br />action against the City of Redwood City dismissed. <br /> <br />2. The City Manager is hereby authorized and directed to <br /> <br />accept the offer of settlement of John W. McCune, Helen McCune <br /> <br />and Ruth Sawyer, plaintiffs in action No. 80761, filed against <br /> <br />the City of Redwood City in the Superior Court of San Mateo <br /> <br />County, for a lump sum payment of $2,500, of which $1,250 is <br /> <br />to be paid to plaintiffs John W. McCune and Helen McCune, and <br /> <br />$1,250 is to be paid to plaintiff Ruth Sawyer. <br /> <br />3. Concurrently upon receipt by the City Treasurer of a <br /> <br />full and complete release of liability satisfactory to and <br />
