McCUNE, HELEN McCUNE, AND RUTH SAWYER vs. CITY OF REDWOOD CITY; AND, AUTHORIZING PAYMENT OF $2, 500 THEREFOR WHEREAS, an action entitled "John W. McCune, Helen McCune and Ruth Sawyer vs. City of Redwood City,.1 No. a0761, is presently pending in the Superior Court of San Mateo County, California, for damages alleged to have been suffered by plaintiffs as a result of installation of certain street improvements by City; and, WHEREAS, plaintiffs in said action have offered to settle said litigation in consideration of the payment to them of a total sum of $2,500; and, WHEREAS, it is the intention and desire of this Council to approve such settlement and authorize the expenditure of the necessary funds therefor; NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. It is in the best interests of the City of Redwood City that the abovementioned lit~gation be settled and the pending action against the City of Redwood City dismissed. 2. The City Manager is hereby authorized and directed to accept the offer of settlement of John W. McCune, Helen McCune and Ruth Sawyer, plaintiffs in action No. 80761, filed against the City of Redwood City in the Superior Court of San Mateo County, for a lump sum payment of $2,500, of which $1,250 is to be paid to plaintiffs John W. McCune and Helen McCune, and $1,250 is to be paid to plaintiff Ruth Sawyer. 3. Concurrently upon receipt by the City Treasurer of a full and complete release of liability satisfactory to and
