<br />#J <br /> <br />,'fl <br />',/ <br />" <br />r ' <br /> <br />. <br /> <br />. <br /> <br />REG:yc:6/10/60 <br /> <br />RES 0 L UTI 0 N N O. <br />---------- <br /> <br />31__tO <br /> <br />RESOLUTION OF THE COUNCIL OF.THE CITY OF REDWOOD CITY FINDING <br />AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE <br />THE ACQUISITION AND CONSTRUCTION BY THE CITY OF REDWOOD CITY <br />OF A PUBLIC IMPROVEMENT, NAMELY A PUBLIC STREET, IN AND UPON <br />THAT CERTAIN REAL PROPERTY HEREIN DESCRIBED; THAT THE ACQUISITION <br />OF A RIGHT OF WAY AND EASEMENTS IN SAID REAL PROPERTY HEREIN <br />DESCRIBED IS NECESSARY FOR SAID PUBLIC IMPROVEMENT; AUTHORIZING <br />THE CITY ATTORNEY TO BRING AN ACTION IN EMINENT DOMAIN TO <br />ACQUIRE SAID REAL PROPERTY FOR SAID PUBLIC IMPROVEMENT AND TO <br />APPLY FOR AN ORDER OF IMMEDIATE POSSESSION OF SAID REAL PROPERTY; <br />AND, AUTHORIZING AND DIRECTING THE CITY MANAGER TO DEPOSIT MONEY <br />IN COURT 'FOR IMMEDIATE POSSESSION OF SAID REAL PROPERTY <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> <br />AS FOLLOWS: <br /> <br />That it hereby finds and determines and declares: <br />That the public interest and necessity require the acquisition <br />and construction by the City of Redwood City of a public improve- <br /> <br />ment, namely, a public street, in and upon that certain real property <br /> <br />hereinafter described; <br /> <br />That the acquisition by the City of Redwood City of a right of <br />way and easements in and upon that certain real property hereinafter <br /> <br />described is necessary for said public improvement; <br /> <br />That said public improvement is the use to which said real prop- <br /> <br />erty is to be applied, and that, said'use is a public use authorized <br />by law; <br />That said public improvement is planned and located in the <br />manner which will be most compatible with the greatest public good <br /> <br />and the least private injury; <br /> <br />AND, BE IT FURTHER RESOLVED': <br /> <br />That the City of Redwood City acquire said right of way and <br /> <br />easements in and upon said real property, for said public improve- <br /> <br />ment, by an action in eminent domain in accordance with the provisions <br /> <br />of the Charter of the City of Redwood City, the provisions of <br /> <br />Article I, Seeton 14, of the Constitution of the State of California, <br /> <br /> <br />and the provisions of the Code of Civil Procedure of the State.of <br /> <br />California relating to eminent domain, said real property being all <br /> <br />that real property situate in the City of Redwood City, County of San <br />Mateo, state of California, more particularly described as follows': <br /> <br />.' <br />
