Acceptance of the initial Agreement for the 2009-2010 Cost Shared Sidewalk Repair Project, SpenCon Construction, Inc. of Danville, CA and execution of Amendment Number 1 of the Agreement REC�MMENDATION 1.) Accept by motion the completed improvements constructed during the 2009-2010 Cost Shared Sidewalk Repair Project, from SpenCon Construction, Inc., Danville, CA and release the ten percent re#ention in the amount of $22,615.42 withheld during the course of construction in accordance with City procedure. � 2.) Authorize execution of Amendment Number 1 to the Agreement in the amount of I, $244,230 ' � � BACKGROUND Un July 27, 2009, the City awarded fihe 2009-2010 Cost Shared Sidewalk Repair contract to SpenCon Construction Inc. of Danville, CA for their bid of $241,025.00. The value of the actual work completed during this project is $226,154.00. All of the work completed during the initial term of the Agreement has been perFormed to City standards. The initial project was done throughout the City at approximately 99 sites and included the construction of 9 curb ramps in compliance with the Americans with Disabilities Act requirement to install accessible paths of travel for sidewalk users. The original agreement includes the option for four extensions using reievant fluctuations in the Construction Cost Index for the San Francisco Bay Area in the Engineering News Record to adjust bid item amounts. Amendment Number 1 will raise the bid item prices by only 1.33% above last year's prices. With this Amendment the total amount paid to SpenCon Construction, lnc. for the Cost Shared Sidewalk Repair Project will not exceed $470,384.63 ALTERNATIVES 1.) City Council could decide to not accept this project. The work has been completed to specifications and the contractor has performed well in the comp(etion of the project. The contractor is due their retention amount. 2.) City Council could decide to not execute Amendment Number 1 to the Agreement and direct stafF to re-bid the project. In the opinion of staff rebidding the project will not result in significant cost savings. FISCAL IMPACT Funds are available in the amount of $244,230 in the Capital Improvement Program, Tree Preservation and Sidewalk Repair Program account.
