Acceptance of the initial Agreement for the 2009-2010 Cost Shared Sidewalk <br /> Repair Project, SpenCon Construction, Inc. of Danville, CA and execution of <br /> Amendment Number 1 of the Agreement <br /> REC�MMENDATION <br /> 1.) Accept by motion the completed improvements constructed during the 2009-2010 <br /> Cost Shared Sidewalk Repair Project, from SpenCon Construction, Inc., Danville, <br /> CA and release the ten percent re#ention in the amount of $22,615.42 withheld <br /> during the course of construction in accordance with City procedure. <br /> � <br /> 2.) Authorize execution of Amendment Number 1 to the Agreement in the amount of I, <br /> $244,230 ' <br /> � <br /> � <br /> BACKGROUND <br /> Un July 27, 2009, the City awarded fihe 2009-2010 Cost Shared Sidewalk Repair <br /> contract to SpenCon Construction Inc. of Danville, CA for their bid of $241,025.00. The <br /> value of the actual work completed during this project is $226,154.00. All of the work <br /> completed during the initial term of the Agreement has been perFormed to City <br /> standards. The initial project was done throughout the City at approximately 99 sites <br /> and included the construction of 9 curb ramps in compliance with the Americans with <br /> Disabilities Act requirement to install accessible paths of travel for sidewalk users. The <br /> original agreement includes the option for four extensions using reievant fluctuations in <br /> the Construction Cost Index for the San Francisco Bay Area in the Engineering News <br /> Record to adjust bid item amounts. Amendment Number 1 will raise the bid item prices <br /> by only 1.33% above last year's prices. With this Amendment the total amount paid to <br /> SpenCon Construction, lnc. for the Cost Shared Sidewalk Repair Project will not exceed <br /> $470,384.63 <br /> ALTERNATIVES <br /> 1.) City Council could decide to not accept this project. The work has been completed <br /> to specifications and the contractor has performed well in the comp(etion of the project. <br /> The contractor is due their retention amount. <br /> 2.) City Council could decide to not execute Amendment Number 1 to the Agreement <br /> and direct stafF to re-bid the project. In the opinion of staff rebidding the project will not <br /> result in significant cost savings. <br /> FISCAL IMPACT <br /> Funds are available in the amount of $244,230 in the Capital Improvement Program, <br /> Tree Preservation and Sidewalk Repair Program account. <br />
