"Developed Property" means, for each Fiscal Year, all Taxable Property for which a building <br /> permit for new construction was issued after January 1, 2010 and on or before May 1 of the <br /> Fiscal Year preceding the Fiscal Year for which the Special Taxes are being levied. <br /> "Final Subdivision" means a subdivision of property by recordation of a final map, parcel map, <br /> or lot line adjustment, approved by the City pursuant to the Subdivision Map Act (California <br /> Government Code Section 66410 et seq.) or recordation of a condominium plan pursuant to <br /> California Civil Code 1352 that, in either case, creates individual lots for which building permits <br /> may be issued without further subdivision. The term "Final Subdivision" shall not include any <br /> Assessor' s Parcel Map or subdivision map or portion thereof, which does not create individual <br /> lots for which a building permit may be issued, including Assessor's Parcels that are designated <br /> as remainder parcels. <br /> "Fiscal Year" means the period starting July 1 and ending on the following June 30. <br /> "Hotel Property" means 2.83 acres of Developed Property located within Lot 1 as depicted for <br /> hotel/retail on One Marina Vesting Tentative Map approved by Redwood City Planning <br /> Commission on July 20, 2010 for which a building permit for the construction of a place of <br /> lodging providing sleeping accommodations and related facilities, including community serving <br /> retail, for travelers is intended to be issued by the City. Furthermore, if Lot 1 described in the <br /> preceding sentence is subsequently changed or modified by recordation of a lot line adjustment <br /> or similar instrument, and only if the CFD Administrator determines that such change or <br /> modification results in a decrease in the Acreage of Lot 1 to below 2.83 acres, then for purposes <br /> of this Rate and Method of Apportionment the sum of the Acreage for all newly created parcels <br /> affected by such lot line adjustment or similar instrument shall be equal to 2.83 acres and <br /> computed as follows: (a) determine the Acreage for each lot created by such lot line adjustment <br /> or similar instrument for which building permits may or have already been issued (a "Buildable <br /> Lot "), (b) divide the Acreage for each newly created Buildable Lot by the aggregate Acreage of <br /> the Buildable Lots calculated in part "a" to determine the percentage of the aggregate Acreage to <br /> be allocated to such lots, and (c) multiply the percentages(s) computed in part "b" by the <br /> aggregate Acreage of the original Lot 1 to determine the number of acres for each Buildable Lot. <br /> "Indenture" means the indenture, fiscal agent agreement, resolution or other instrument <br /> pursuant to which CFD No. 2010 -1 Bonds are issued, as modified, amended and/or <br /> supplemented from time to time. <br /> "Land Use Class" means any of the classes listed in Table 1 and Table 2, below. <br /> "Location" means Marina View Property or Non -Marina View Property as defined in this <br /> Section A. <br /> "Marina Property" means all property located within Lot 4 as depicted for existing preserved <br /> marina basin on One Marina Vesting Tentative Map approved by Redwood City Planning <br /> Commission on July 20, 2010. <br /> B -4 <br /> 302108_1.doc <br />
