• Is an adult who is identified as having a developmental disability with an <br /> onset before the age of 18, whose disability is substantial and will impact <br /> three or more areas of life functioning, and who has been identified as a <br /> person with a developmental disability by a state or regional center or has <br /> contested a regional center's negative determination regarding a <br /> diagnosis of a developmental disability. <br /> • Is determined to be an extremely low income person having an annual <br /> household gross income no greater than 30% of the Area Median Income <br /> (as defined in Paragraph 10 of the Agreement). As of the date of this <br /> Agreement, the maximum income limit for an extremely low income <br /> household of one for San Mateo County is $22,600. <br /> • Shall be eligible for occupancy for a minimum period of 12 months. <br /> The maximum number of Qualified Persons that may reside in the Dwelling on <br /> the Property at one time shall be limited to six (6). However, Kainos may set <br /> aside one of the nine bedrooms in the Dwelling Unit to be occupied by a person <br /> employed as on on -site manager and such unit shall not be subject to the income <br /> limits set forth for Qualified Persons, nor shall it be used in calculating the <br /> maximum per unit subsidy amount set forth in subparagraph 4 below. <br /> The income affordability and occupancy restrictions, including monitoring and <br /> reporting requirements, are more fully set forth in the Declaration of Affordability <br /> Covenants and shall remain in effect for fifty -five years following its recordation. <br /> 4. Maximum Per Unit Subsidy <br /> Kainos shall cause HOME funds allocated to this project not to exceed the <br /> maximum per unit subsidy amount as defined by HOME regulations and as set <br /> forth below. <br /> MAXIMUM PER UNIT SUBSIDY <br /> Unit Type Maximum per unit HOME <br /> Subsidy <br /> 221(d)3 Elevator $ <br /> 4 + bedrooms ( +2) $ 103,863.00 <br /> 260% Base City High Cost $ 270,043.80 <br /> 5. Complaint Resolution Process <br /> Kainos shall develop and adopt a Complaint Resolution Program for client and <br /> neighborhood concerns. The Complaint Resolution Program must provide a <br /> grievance and appeal process for the client, and must include a third party <br /> mediation, like Peninsula Conflict Resolution Center or any other established <br /> mediation facilitation organization, to facilitate the resolution of neighborhood <br /> issues not resolved by Kainos. <br /> Exhibit B <br /> Page 2 of 5 <br />
