The impact identified above is described and discussed on pages 4.3-29 to 4.3-30 of the DEIR. b) Mitigation Measures. FEIR Mitigation Measure 4.3-1 (p. 4.3-30 of the DEIR) is hereby adopted and will be implemented by the revision of New General Plan Public Safety Element Implementation Program PS-6 to ensure that the potential air quality impacts from new development projects in the City be evaluated pursuant to the applicable BAAQMD CEQA Guidelines in effect at the time the City commences the air quality evaluation, including, as applicable, the establishment of specific overlay zones around existing and planned sources of TACs. c) Findings. Based on the FEIR and the entire record before the City, the City Council finds that Mitigation Measure 4.3-1 would reduce this impact to a less than significant level because it would require that future development projects in the City be evaluated pursuant to the applicable BAAQMD CEQA Guidelines in effect at the time the City commences the air quality evaluation for those projects, thereby ensuring that appropriate buffer zones are established around existing and planned sources of TACs and reducing exposure of sensitive receptors to TAC emissions. Impact 4.4-1: Development allowed by the New General Plan could result in the loss of habitat,mortality,or indirect impacts to special status species. a) Potential Impact. The impact identified above is described and discussed on pages 4.4-30 to 4.4-32 of the DEIR. b) Mitigation Measures. The following mitigation measures are hereby adopted and will be implemented by modifying the implementation programs in the New General Plan described therein, and by requiring as conditions of approval for all future projects proposed under the New General Plan that the project proponents obtain all necessary permits relating to affected riparian habitat or Waters of the United States prior to the issuance of any grading or building permits: FEIR Mitigation Measure 4.4-la (p. 4.4-32 of the DEIR). FEIR Mitigation Measure 4.4-lb (p. 4.4-32 to 4.4-33 of the DEIR). FEIR Mitigation Measure 4.4-1c (p. 4.4-33 of the DEIR). c) Findings. Based on the FEIR and the entire record before the City, the City Council finds that Mitigation Measures 4.4-la through 4.4-1c would reduce program-level impacts to sensitive biological resources to a less than significant level because the implementation programs contained in the New General Plan, as amended by these mitigation measures, would ensure that new development proposals adhere to the New General Plan requirements for avoiding sensitive biological resources and for developing compensations plans for harm to sensitive biological resources, and would also require new development proposals to comply with federal and state regulations ATTYIRESO IRES0.2055/ATTACHMENT1.A 17 10/6/10 1
