REVISED REPORT To the Honorable Mayor and City Council From the City Attorney October 11, 2010 Subject Termination of local emergency arising from ruptured sewer main at Redwood Shores Recommendation Adopt a Resolution Proclaiming the Termination of the Local Emergency. Background On September 1, 2010, the City Manager proclaimed the existence of a local emergency due to a ruptured sewer force main. On September 8, 2010, the City Council confirmed the City Manager's declaration of emergency and ratified the actions taken pursuant to that authority including entering into contracts without competitive solicitation in order to divert sewage, repair the main, and clean up surface water, streets, and residences after the rupture. The City Council is required to review the emergency at every meeting until the emergency is terminated, and did so at its meetings occurring on September 13 and 27, 2010. The rupture of the sewer force main resulted in the release of sewage into six residential garages, and the Redwood Shores lagoon. City staff responded to the rupture by diverting the sewage from the ruptured main, repairing it, and repairing damage to the surrounding residential area, as well as cleaning up and restoring the residential garages. City staff also responded to release of sewage into the surface waters of the Redwood Shores lagoon by applying a treatment to improve water quality within the lagoon. This local emergency was further complicated when a small private airplane crashed into the Redwood Shores lagoon on September 2, 2010. This plane crash created an additional emergency, requiring responses from the Redwood City police and fire departments. As a result of the plane crash, it was necessary for the City to deploy a containment boom in an effort to prevent oil and gasoline from spreading away from the crash site into the surrounding waters of the Redwood Shores lagoon. A summary of payments made to vendors in order to directly address the local emergency is provided below. Additional invoices may be paid to these companies; however, staff will not enter into any additional agreements without following standard City practices including observing the competitive bidding requirements set forth in the City Charter, Municipal Code, and state law, if so required.
