10/11/2010 <br />Attachment 1.A <br />requiring mitigation of impacts on riparian habitat, wetlands and other waters of the <br />United States. <br />Impact 4.4 -2: Development allowed by the New General Plan could result in <br />the loss of habitat, mortality or indirect impacts to special status plant species. <br />a) Potential Impact. The impact identified above is described and discussed <br />on pages 4.4 -33 to 4.4 -34 of the DEIR. <br />b) Mitigation Measures. The following mitigation measures are hereby <br />adopted and will be implemented as provided in the Mitigation Monitoring and Reporting <br />Program: <br />FEIR Mitigation Measure 4.4 -2a (p. 4.4 -34 of the DEIR). <br />FEIR Mitigation Measure 4.4 -2b (p. 4.4 -34 of the DEIR). <br />C) Findings. Based on the FEIR and the entire record before the City, the <br />City Council finds that Mitigation Measures 4.4 -2a and 4.4 -2b would reduce program - <br />level impacts to special status plant species to a less than significant level because <br />proponents of new development proposals that would affect special status plants will be <br />required to retain a qualified botanist to: (a) conduct a survey for special status plants <br />and prepare recommendations for avoiding or minimizing impacts to such plants <br />according to protocols established by the California Native Plant Society (CNPS), the <br />California Department of Fish and Game (CDFG), and /or the U.S. Fish and Wildlife <br />Service (USFWS); and (b) and if loss of special status plants is not avoidable, prepare <br />compensation plans to compensate for such losses according to CNPS, CDFG, and /or <br />USFWS standards. Such surveys, recommendations, and compensation plans shall be <br />reviewed by the decisionmaking body of the City prior to project approval and the <br />recommendations and mitigation measures in the compensation plans shall, to the extent <br />feasible as determined by the City, required as conditions of project approval. <br />Impact 4.4 -3: Development allowed by the New General Plan could result in <br />the loss of habitat, mortality or indirect impacts to special status animal species. <br />a) Potential Impact.
