10/11/2010 <br />Attachment 1.A <br />same policies and programs relating to sustainability, historic preservation and <br />community character, alternative transportation, and neighborhood and community <br />participation in community development and government that would be implemented by <br />the New General Plan. As a result, Alternative 3 would be expected to achieve the City's <br />related goals and objectives to nearly the same degree as the New General Plan, although <br />the slightly reduced level of non - residential development anticipated under Alternative 3 <br />could result in slightly lower fee revenues that might be used to implement infrastructure <br />improvements, public facilities and programs contemplated by these policies and <br />programs. <br />Because Alternative 3 would not be expected to substantially reduce or avoid any of the <br />potentially significant effects that are expected from the mitigated New General Plan, and <br />because Alternative 3 would not achieve the City's goals and objectives for the Project to <br />quite the same extent as the New General Plan, the City hereby rejects Alternative 3 from <br />further consideration. <br />IV. Statement of Overriding Considerations. <br />Pursuant to Public Resources Code Section 21081 and Section 15093 of the <br />CEQA Guidelines, this City Council adopts and makes the following Statement of <br />Overriding Considerations regarding the remaining significant unavoidable impacts of <br />the Project, as discussed above, and the anticipated economic, social and other benefits of <br />the Project. <br />The City finds and determines that: (i) the majority of the significant <br />impacts of the Project will be reduced to less- than - significant and acceptable levels <br />by the mitigation measures described in the Final EIR and approved and adopted by <br />these Findings; (ii) the City's approval of the Project will result in certain significant <br />adverse environmental effects that cannot be avoided even with the incorporation of all <br />feasible mitigation measures into the Project; and (iii) there are no other feasible <br />mitigation measures or feasible Project alternatives that would further mitigate or avoid <br />the remaining significant environmental effects. The significant effects that have not <br />been mitigated to a less- than - significant level and are therefore considered significant and <br />unavoidable are: <br />• Impact 4.3-1: The projected population growth allowed by the New <br />General Plan would be inconsistent with growth projections in the current <br />regional Clean Air Plan, in that the projected population allowed by the <br />New General Plan would increase at a greater rate than regional <br />projections utilized within the Clean Air Plan. <br />• Impact 4.14 -1: New development allowed under the New General Plan <br />could cause an increase in traffic that is substantial in relation to the <br />existing traffic load and capacity of the roadway system and result in <br />unacceptable service levels on some roadway segments based on current <br />LOS policy. <br />ATTY /RESO /RESO.2055 /ATTACHMENT1.A 38 #15059 <br />10/13/10 MUFF # 601 <br />
