Legislative Bill Action
very clear local control and anti - preemption
language. It states: "(a) Nothing in this division
preempts or supersedes any local tobacco control
law other than those related to the collection of
state tax. (b) A local licensing scheme may
include, but is not limited to the following: (1)
Penalties for violation of local laws regulating the
retail sale of cigarettes and tobacco products,
including the suspension or revocation of the local
license. (2) Provisions for the suspension or
revocation of the local license for violation of state
laws regulating the retail sale of cigarettes and
tobacco products."
Currently about two dozen cities have existing
tobacco retailer licensing programs. These
programs would not be impacted by AB 71.
Interested cities should review AB 71 and send
their comments to the League's Sacramento
office. Staff: Yvonne Hunter, Status: Hrg possible
in AsGO, mid - March, Position: Review and
Comment.
SB 184 (Sher). San Francisco Bay Conser-
vation and Development Commission. SB
184, of interest to cities within the jurisdiction of
the BCDC, would make a number of changes to
existing law relative to the authority of the BCDC
to issue and revoke permits and to issue civil
penalties for violations of permit conditions issued
by or on behalf of the Commission. Interested
cities should review the bill and send their com-
ments to the author. Staff: Yvonne Hunter, Sta-
tus: Pending, SenJud and SenNatRes &Wild,
Position: Watch.
