W 2 0-1 <br />March 10, 2003 <br />Subject <br />Introduction of an Ordinance amending Articles II and III of Chapter 1 of the Redwood City <br />Municipal Code providing for Administrative Code Enforcement. <br />Adoption of a Resolution setting forth the administrative citation schedule of fines and other <br />administrative penalties for violations of the City of Redwood City Municipal Code. <br />Recommendation <br />Introduce the attached Ordinance amending Articles II and III of Chapter 1 of the Redwood <br />City Municipal Code providing for Administrative Code Enforcement. <br />Adopt the attached Resolution setting forth the administrative citation schedule of fines and <br />other administrative penalties for violations of the City of Redwood City Municipal Code. <br />Background <br />In 1999 the City Council adopted a comprehensive administrative code enforcement <br />program. The program, among other things, allows staff to issue administrative citations to <br />individuals who violate the Municipal Code. Citation fines are paid directly to the City and <br />contested citations are heard though an administrative hearing process, not the criminal <br />court system. Also in 1999, the City Council adopted Resolution No. 13747 setting forth a <br />schedule of fines for administrative citations. <br />The City's administrative enforcement program, based in large part on one developed over <br />ten years ago in San Jose, provides for two primary enforcement tools — administrative <br />citations and administrative orders. Administrative citations have been successfully used <br />by the Code Enforcement Division of the Community Development Services Department <br />since the program's adoption. The Code Enforcement Division has, however, had only a <br />very limited use of administrative orders. <br />Unlike administrative citations, administrative orders are reserved for the more serious <br />violations of the Municipal Code, particularly those involving continuing zoning or building <br />violations. Once it has been determined that voluntary compliance cannot be obtained, an <br />enforcement officer may issue a compliance order to the responsible party. The <br />compliance order describes the violation, explains what is required to bring the property <br />into compliance and provides a date by which compliance must be achieved. The <br />compliance order also notifies the responsible party that administrative penalties may <br />accrue if compliance is not achieved by a specified date. <br />DBB /Reports /Admin <br />020603 <br />
