REPORT <br />To the <br />March 24, 2003 <br />Honorable May r and City Council <br />From the City Manager <br />Subject <br />Avigation and Public Access Easement for Property Leased by Shores Child Care LLC <br />Recommendation <br />The Council, by motion, approves and authorizes the City Manager to execute an Avigation <br />Easement with the County of San Mateo and a Public Access Easement with the Bay <br />Conservation and Development Commission (BCDC) for the property leased to Shores <br />Child Care, LLC. <br />Background <br />Mr. Max Keech, operating as Shores Child Care, LLC, entered into a ground lease for the <br />Water Tank "A: site in Redwood Shores with the City of Redwood City and developed a <br />child care center that opened in January of 2003. Two agreements for easements are <br />required in connection with this development project. The Ground Lease between the City <br />and Shores Child Care, LLC, in Section 7 b states that the Lessor (City) shall, "cooperate <br />with the Leasee in executing and recording an avigation easement against the Leased <br />Premises if required by the San Mateo County Airport Land Use Commission.
