Co, tQ -lZ -2- <br />Agreement Imposing Public Access Restrictions <br />on the Use of Real Property <br />This agreement is made this day of , 20 by and <br />between Shores Childcare, LLC, and The City of Redwood City, hereinafter collectively <br />referred to as "the permittees," and the San Francisco Bay Conservation and <br />Development Commission, hereinafter referred to as "Commission." <br />WHEREAS, the co- permittee, City of Redwood City, owns certain real property <br />referred to as "the subject property" that is located in the City of Redwood City, County <br />of San Mateo, State of California, and is more particularly described in Exhibit A, <br />attached hereto and by such reference incorporated herein and where as co- permittee, <br />Shores Childcare, LLC, leases the subject property from co- permittee, City of Redwood <br />City; <br />WHEREAS, pursuant to the McAteer - Petris Act (Government Code Section <br />66600 et sea. the permittee sought in Application No. 3 -01 a permit for the following: <br />TO CONSTRUCT PORTIONS OF A CHILDCARE /OFFICE FACILITY AND <br />PUBLIC ACCESS IMPROVEMENTS ON A 1.9 ACRE PARCEL SOUTH OF <br />PICO BOULEVARD AND NORTH OF THE SAN CARLOS AIRPORT, IN THE <br />CITY OF REDWOOD CITY, SAN MATEO COUNTY; and <br />WHEREAS, the Commission has issued Permit No. 3 -01, a copy of which is <br />attached as Exhibit B and incorporated by reference, for this work and the uses subject to <br />conditions that are imposed for the benefit of the public and surrounding landowners, an d <br />without agreement to which by the permittee no permit could be issued; and <br />
