<br />AB 507 (Hancock) Public Safety Officers:
<br />Off -Duty Employment. AB 507 requires that a
<br />probationary employee of a public agency (exclud-
<br />ing school employees) whose employment has
<br />been terminated shall be given a written statement
<br />of the reasons for termination. No such require-
<br />ment exists in current law.

<br />Mandating a provision of a written statement
<br />regarding reasons for termination of probationary
<br />employees will dampen communications between
<br />employers and probationary employees. Employ-
<br />ers will fear that those communications will
<br />inadvertently, out of in -artful selection of language,
<br />serve as the basis for one of the expensive
<br />causes of action currently available to probation-
<br />ary employees. The net result will be carefully
<br />formulated and generally non - substantive commu-
<br />nications that will not permit the free exchange of
<br />communication otherwise necessary for a suc-
<br />cessful probationary period. In addition, the
<br />written communications may serve to encourage
<br />more use of available administrative remedies by
<br />probationary employees.
<br />There is nothing in AB 507 that cannot already
<br />be implemented voluntarily by public employers,
<br />including through the collective bargaining process
<br />available to public employees. This bill is an
<br />' unnecessary, costly and burdensome unfunded
<br />state mandate that will inhibit the instructive value
<br />of probationary periods of employment. Staff:
