= i� <br />Legislative Bill Action <br />................................ ............................... <br />The following are summaries of just a few of the legislative bills that are currently being acted upon <br />by the League of Califomia Cities. State- Mandated Local Pro- <br />grams. The League jointly sponsored a similar bill <br />in the 2001 -02 session with the California State <br />Association of Counties and the California School <br />Boards Association to make much needed changes <br />to the state mandate process. Membership on the <br />Commission on State Mandates would be increased <br />to include a local government alternate who would <br />have voting rights if one of the voting local govern- <br />ment representatives was absent. This would be <br />comparable to the state alternate who currently has <br />these voting privileges. AB 637 would limit legal <br />representation for the Commission in certain actions <br />challenging the quasi - judicial findings of the Com- <br />mission. Certain procedural changes such as <br />requiring an audit of claims to be completed within <br />three years and revising the time period for filing a <br />claim will provide greater accountability and access <br />to the reimbursement process. Staff: Jean Korinke, <br />Status: AsLG;Hrg -4/9, Position: Support. <br />TRANSPORTATION AND PUBLIC WORKS <br />AB 872 (Strickland). Vehicles. Speed Limits. <br />Divided Urban Highways. AB 872 increases a <br />local agency's ability to set speed maximum speed <br />limits on specified types of urban streets, rather <br />than relying on the current inflexible formula that <br />essentially gives speeders a role in setting posted <br />limits. AB 872 would set the speed limit on an <br />urban, divided, restricted - access arterial highway at <br />not to exceed 45 mph unless specific findings are <br />made by a local agency that a higher speed is safe. <br />Currently, speed limits on city streets must be set <br />using traffic surveys that measure how fast most <br />motorists actually travel. Courts have ruled that <br />setting limits lower than the speed at which almost <br />all people drive creates a speed trap. AB 872 will <br />not create speed traps or confuse drivers with <br />inconsistent speed limits, and -it would be consistent <br />with proven engineering principles. Staff: Natasha <br />Fooman, Status: AsTrans;Hrg -4/7, Position: <br />Support. <br />A 1022 (Oropeza). Vehicles. Automated <br />Enforcement Systems. AB 1022 defines the term <br />"operate" for the purposes of automated enforce- <br />ment systems. "Operate" as defined in the bill <br />means the following: (1) Developing uniform guide- <br />lines for screening and issuing violations and for the <br />processing and storage of confidential information, <br />and establishing procedures to ensure compliance <br />with those guidelines; (2) Performing administrative <br />functions, including, but not limited to, all of the <br />following: (a) Establishing guidelines for selection of <br />location; (b) Ensuring that the equipment is regu- <br />larly inspected; (c) Certifying that the equipment is <br />properly installed and calibrated, and is operating <br />properly; (d) Regularly inspecting and maintaining <br />warning signs placed under paragraph (1) of <br />subdivisions (a); (e) Overseeing the establishment <br />or change of signal phases and the timing thereof; <br />and (f) Maintaining controls necessary to assure <br />that only those citations that have been reviewed <br />and approved by law enforcement are delivered to <br />violators.
